RESOLUTION MODIFYING UNDERGROUND UTILITY DISTRICT
NO. 2, DIVISION 36 (STINE ROAD, PANAMA LANE TO
RYZONA STREET)
WHEREAS, on August 13, 2014, the Council of the City of Bakersfield
adopted Resolution No. 149 -14 establishing Underground Utility District No. 2,
Division 36 (Stine Road, Panama Lane to Ryzona Street) (the "District "); and,
WHEREAS, after District was established, PG &E's underground
project within District changed, thus requiring a modification of District's
boundaries to reflect the scope of PG &E's underground project; and,
WHEREAS, no underground work has been done as of this date;
and,
WHEREAS, the City desires to modify District's boundaries as
established by Resolution No. 149 -14 to match that of PG &E's underground
project by removing the intersections of Panama Lane and Stine Road and
Ryzona Street and Stine Road from District's boundaries; and,
WHEREAS, after the modification, District will encompass the parcels
with direct frontage on Stine Road between Panama Lane and Ryzona Street,
excluding the intersections of Stine Road and Panama Land and Stine Road
and Ryzona Street; and,
WHEREAS, on October 14, 2015, the Council of the City of Bakersfield
adopted Resolution of Intention No. 1855 setting a public hearing on the
modification of District's boundaries, as shown in Exhibit "A," attached hereto,
for 5:30 p.m. in the Council Chambers in the City Hall, 1501 Truxtun Avenue,
Bakersfield, California; and,
WHEREAS, notice of the hearing has been given to all affected
property owners as such are shown on the last equalized assessment roll and to
all utilities concerned in the manner and within the time required by law; and,
WHEREAS, such hearing has been duly and regularly held, and all
persons interested have been given an opportunity to appear and be heard.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield that:
1. The above - reference recitals are incorporated herein by reference.

2. District's boundaries are hereby modified as reflected in Exhibit A.
3. The City Clerk is hereby instructed to notify all affected utilities and
all persons owning real property within District of the adoption of this
Resolution within ten (10) days after the date of such adoption.
Such notification shall be made by mailing a copy of this Resolution
to all affected property owners as such are shown on the last
equalized assessment roll and to the affected utilities.
4. All other provisions of Resolution 149 -14, except for the modifications
to the District's boundaries as provided herein, shall remain in full
force and effect.

Those portions of Sections 26 and 27, T30 South, Range 27 East, Mount
Diablo Base and Meridian, in the City of Bakersfield, County of Kern, State
of California, more particularly described as follows:
All of Stine Road from Panama Lane south to Ryzona Street, excluding the
intersection of Stine Road and Panama and the intersection of Stine Road
and Ryzona Street, and including all parcels with frontage on Stine Road
between Panama Lane and Ryzona Street, excluding lots 1, 20 and 21 of
Tract 6639 and Lots 1 and 41 of Tract 6141.
