High Speed Rail News
■ The legal hurdles are mounting for the High Speed Rail Authc

SMG Appoints New General Manager of Bakersfield VenuE
SMG is pleased to announce the appointment of Scott Neal as General Manager of th
facilities owned by the City of Bakersfield, including the Rabobank Arena, The
Convention Center, Bakersfield Ice Sports Center, and Bright House Ne
Amphitheater.
Since joining SMG in 2008, Neal has worked at INTRUST Bank Arena in Wichita,
as Assistant General Manager/Director of Event Services and Marketing Director. V�
INTRUST Bank Arena, Neal was intricately involved in the grand opening of the i
and was responsible for booking events, event production and marketing.
Prior to joining SMG, Neal worked for several other facilities, including Kemper
American Royal Center in Kansas City, EnergySolutions Arena and Maverik Center
Lake City, and Fargodome in Fargo. In addition, Neal has also worked for the ]
Globetrotters and VEE Corporation (producers of Sesame Street Live).

Once again, a judge on Thursday ordered the state
to scrap its plans to zip high-speed trains from
Gilroy to San Jose and up the Peninsula, saying
officials failed to show how the massive route would
harm local traffic and homes.
Even so, the California High-Speed Rail Authority
signaled it would reapprove the route along the
Caltrain corridor after completing more studies to
appease the judge. That could trigger yet another
lawsuit, extending a three-year long legal battle
against the polarizing $99 billion bullet train
project.
The cities of Palo Alto, Menlo Park and Atherton
don't want the elevated tracks to divide their
communities, create an eyesore and lower property
values. So they sued in October 2010 to ax the Bay
Area route for the San Francisco-to-Los Angeles
line. They prefer a railroad that would run through
the East Bay and across the Dumbarton Bridge to San
Francisco.
Sacramento Superior Court Judge Michael Kenny
ruled that the rail authority must rescind the
Peninsula route to study how the traffic in the far
South Bay would suffer if the tracks force the
elimination of lanes on Monterey Highway. He said
it also needs to examine how Peninsula residents
and roads would be handicapped by freight trains
running closer to properties.
The same thing has happened before. The cities first
sued in August 2008, and a year later Kenny
ordered the rail authority to rescind the route and
redo some of its planning. By September

The lawsuit merry-go-round may not be over any
time soon, though, said Stuart Flashman, the
attorney for the cities, a group of Peninsula
residents and two anti-bullet train groups.
"That may be the take-home message here, that
authority will have to keep doing this until they gE
it right," Flashman said. "I don't know how many
times" we'll sue.
It's unclear if further court battles could delay the
start of construction in the Central Valley, slated
next year, though the rail authority argued it was
not a "major setback."
Despite the judge's main ruling, the rail authority
released a statement claiming victory since Kenr
rejected other allegations that its rider estimates
were flawed, that underground tracks should be
studied for the Peninsula and that an alternative
route involving local highways deserves merit.
"The two biggest issues in these lawsuits were
ridership and route alternatives, and the court ru

Kings County and two of its residents filed a lawsuit against the California High Speed Rail P
stating that its plan for the central San Joaquin Valley portion of the rail line violates sections
Proposition 1 A.
The suit, filed Monday in Sacramento County Superior Court, claims that the authority's use
from Prop 1A, which created the agency and commissioned a high-speed rail line, cannot bE
current plans.
According to the suit, the authority's construction of the Valley portion of the rail line illegally �
1A bond funds for a non-electric, or conventional, rail line. The suit states that because the p

"preliminary" stage -- violates state law.
Redwood City attorney Michael Brady, who is representing Kings County and co-plaintiffs Jo
Aaron Fukuda, said the authority failed to seek approval from the Public Utilities Commissior
agencies following the passage of Prop 1A.
The suit also challenges the state's obligations to pay for the Valley rail line under current co
projections. Under Prop 1A, bond funding could not exceed 50% of the funds spent on the V
segment. Currently, the U.S. Department of Transportation has granted about $3 billion, whic
to a total of $6 billion available for the first segment. The total cost of the segment is estimatE
billion, the suit says.
Because of the disparity in available funds and cost projections, the plaintiffs asked that the �
business plan, released Nov. 3, be declared out of compliance with the proposition and that i
funding be supplied under Prop 1A.

AT&T occasionally modifies the channel availability for the AT&T U-verseOO TV service. As wE
previously advised, our carriage agreement with Current TV (channel 189) is set to expire on
27, 2011. Current TV (channel 189) will continue to be available to U-verse members througl
however, there is a possibility that as of midnight on November 27, 2011, if a reasonable agre
cannot be reached with the programmer, we will no longer carry the programming. However
agreement is reached, Current TV (channel 189) may move from U200 to U300, or from U200
on December 15, 2011.
As stated below our carriage agreements with HDNet (channel 1105 in HD) and Wealth TV (cl
470 and 1470 in HD) are set to expire on December 31, 2011. HDNet (channel 1105 in HD) ai
TV (channels 470 and 1470 in HD) will continue to be available to U-verse members through �
however, there is a possibility that as of midnight on December 31, 2011, if a reasonable agre�
cannot be reached with the programmer, we will no longer carry the programming. However
agreement is reached, HDNet (channel 1105 in HD) and Wealth TV (channels 470 and 1470 ir
move from U200 to U300, or from U200 to U450 after January 1, 2012.
On january 1, 2012, Fox Business Network (channels 211 and 1211 in HD) will move from U3
U200, and Fox News Channel (channels 210 and 1210 in HD) will move from U100 to U200.
AT&T's contracts with programmers for the content displayed on our U-verseOO TV service pe
expire, but are usually re-negotiated or extended with no interruption or change for our U-ve�
members. The current contracts for the programming indicated below will expire soon, and �
making every effort to reach a fair agreement to continue carriage. However, if reasonable ag
cannot be reached with such programmers, we will no longer have the rights to carry their
