The la contends that AB 1484 contains unconstitutional property and sales tax claw-back and other pr that violate the California State Constitution, including both Proposition 1 A(2004) and Prop. 2; The petition does not seek to invalidate AB 1484 in its entirety, but it is being filed to ensure th� down of redevelopment agencies is executed in an orderly and constitutional fashion without je the fiscal stability of cities as they work to faithfully implement the redevelopment dissolution le The plaintiffs are: the League of California Cities, the city of Vallejo, the Vallejo Successor Age League Executive Director Chris McKenzie as the taxpayer plaintiff. The defendants are: the D of Finance, the Board of Equalization, the State Controller and the Solano County Auditor Coni In the lawsuit the petitioners contend that AB 1484 lacks sufficient standards to guide and con� Department of Finance's decision making authority in a number of significant areas. The follow provisions are being challenged as unconstitutional: • The "true-up" payment requirement; • The Department of Finance's authority to order the Board of Equalization to withhold s� from those cities whose successor agencies failed to make the July "true-up" payment other circumstances; • County auditor-controllers' authority to withhold property taxes in certain circumstance: • Those provisions of AB 1484 that establish an unconstitutional delegation of legislative to the Department of Finance. The League also asserts in the lawsuit that the Department of Finance has not complied with tf Administrative Procedure Act (Act), which provides the procedures by which state agencies m� regulations. The Department of Finance has adopted no regulations under the Act to implemer League President and Pasadena Mayor Bill Bogaard: "By dissolving redevelopment agencies, Legislature and Governor eliminated California's most effective tool to build infill infrastructure, brownfields and build affordable housing. While disagreeing with that decision, city officials ha� accepted it and are working to implement the law in a conscientious and lawful manner. Judge Timothy Frawley ordered Friday that three separate lawsuits against the California Hic Rail Authority will be combined for future hearings in Sacramento Superior Court. The cases challenging the rail authority's final approval of environmental reports and a route between N Fresno -- one of the first sections of tracks that the authority hopes to begin building next ye< All three suits were filed within weeks of the rail authority board's May 3 vote approving the � One by the Madera County Board of Supervisors, Madera County Farm Bureau, Merced Co� Bureau, Chowchilla Water District, Preserve Our Heritage, and the Fagundes farming family and Merced counties. One by the city of Chowchilla. One by Timeless Investment Inc. and other companies that own property along the proposec Madera and Fresno counties. A hearing on the suits' requests for injunctions has been set for Nov. 16 in Sacramento. A pr injunction, if granted by the judge, would prevent the rail authority from moving forward with 1 until a trial on the lawsuits is completed. Attorneys for the rail authority had argued in court documents that a hearing for a preliminar� was not necessary before April 2013, "and certainly is not necessary before December."
