RESOLUTION OF THE BAKERSFIELr>
CITY COUNCIL REQUESTING
THE KERN COUNTY LOCAL AGENCY FORMATION
COMMISSION TO APPROVE AN AMENDMENT TO THE CITY'S
SPHERE OF INFLUENCE_
WHEREAS, A Sphere of Influence (SOI) defines an area for the probable physical
boundaries and service area of a local government agency; and
WHEREAS, the Local Agency Formation Commission (LA FCo) is required to
determine the SOI of each local government agency; and
WHEREAS, LA FCo is required to update the City's SOI every 5 years and the last
update to the City's SOI was in 2006; and
WHEREAS, a change to the SOI is necessary to accommodate a proposed
annexation (Annexation No_ 659, Stockdale Highway No_ 1 7) where a portion of the
property (1 46,400 square feet) was left out of the City's SOI; and
WHEREAS, the SOI amendment area was pre -zoned (Ordinance No_ 4822) with
Agriculture zone district in order to pursue annexation of the property; and
WHEREAS, the City's pre - zoning within the SOI amendment area was determined
to be exempt from CEC�tA pursuant to Section 1 5061 (b) (3) of the CEQA Guidelines; and
WHEREAS, if any city desires to amend its adopted SOI, the City Council by
resolution (pursuant to Section 56428 of the Government Code) may file a request with
the LAFCo executive officer; and
WHEREAS, o Municipal Services Review was prepared in 2006 and an update has
been prepared for this SOl amendment_
NOW, THEREFORE, BE IT RESOLVED by the Bakersfield City Council as follows=
1 _ The above recitals and findings incorporated herein ore true and correct_
2_ Staff
is directed to submit an application to LA FCo to amend the City's
Sphere of Influence_
3_ The Municipal Service Review is to be included in the application to
LAFCo_
4_ The City Council hereby requests an amendment of the City of
BaKersfield's adopted Sphere of Influence by the Kern County LA FCo
under provisions of Government Code Section 56428, to odd lands that
could be annexed and serviced by the City of Bakersfield in the future, as
shown on the attached map, incorporated herein as Exhibit "A_„ o�otaKF9�

5. The City Clerk is directed to transmit a certified copy of this resolution to
the Executive Officer of the Kern County Local Agency Formation
Commission.
HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the
Council of the City of Bakersfield at a regular meeting held on
