NOTICE OF RIGHT TO APPEAL Planning Commission decisions on Zone Changes, Parcel Maps and Tentative Subdivision maps are subject to appeal by any person aggrieved. No permit shall be issued for any use involved in an application until after the final acceptance date of appeal. Such appeal must be filed in writing within 10 days from date of hearing, addressed to the City Council, cio Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $330 non-refundable filing fee must be included with filing of the initial appeal for those aPpeals filed by the applicant or any person outside the notice area. All appeals filed on land divisions will require a $330 non-refundable filing fee. If all appeals are withdrawn prior to the City Council hearing, it will not be conducted and the decision of the Planning Commission will stand. If no appeal is received within the specified time period or if all appeals filed are withdrawn, the action of the Planning Commission shall become final. PUBLIC HEARING -- PUBLIC SCOPING MEETING FOR SOUTH BEL'I'WAY FREEWAY TRANSPORTATION CORRIDOR DRAFT PROGRAM ENVIRONMENTAl, IMPACT REPORT. 11. Staff report was given. Staff Planner indicated the consultant would be present at Thursday's meeting to discuss environmental issues. Responding to question by Commissioner Kemper concerning financing, Mr. LaRochelle said this is a long-term planning process in which the exact location is being identified, there are no funding issues at this time. GENERAL PLAN CONSISTENCY FINDING - PROPOSED ACQUISITION OF PROPERTY AT THE NORTHWEST CORNER OF WINDSOR PARK DRIVE AND DORCHESTER STREET. COMMUNICATIONS Page 4 A) Written Mr. Grady, said a copy of the Planner's Institute Conference schedule was given to the Commission. He also stated an item would be added to Thursday's agenda concerning the facilities plan for North of the River Parks. B) Verbal 13. COMMISSION COMMENTS Concerning the donation of 45 acreS of natural wetland area by Mr. Carosella, Mr. Grady said this issue is being looked at and a response should be forthcoming. A. Committees' Commissioner Ortiz asked if a Hillside Committee meeting would be held on this day.~ Mr. Grady stated he thought there would be a quorum so that this meeting could be held. 14.
