NOTICE OF RIGHT TO APPEAl Planning C~ommission decisions on Zone Changes, Parcel Maps and Tentative Subdivision maps are subject to appeal by any person aggrieved. No permit shall be issued for any use involved in an application until after the final acceptance date of appeal. ~ Such appeal must be filed in writing within 10 days from date of hearing, addressed to the City Council, c/o Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $330 non-refundable filing fee must be included with filing of the initial appeal for those appeals filed by the applicant or any person outside the notice area. All appeals filed on land divisions will require a $330 non-refundable filing fee. If all appeals are withdrawn prior to the City Council hearing, it will not be conducted and the decision of:the Planning Commission will stand. If no appeal is received within the specified time period or if all appeals filed are withdrawn, the action of the Planning Commission shall become final. Commissi°ner Sprague asked for an explanation of the condition regarding school fees, whether the applicant would pay the higher fee assessed for prior zone chadges, or would theY pay the standard fee. Staff indicated that the subject fees were addressed in Items 20 and 21; exact figures would be researched and provided at a later time. Commissioner Tavern requested clarification of impact fees mentioned in Items 20 and 21: Ms. Shaw indicated that the transportation impact fee is covered under Condition 1.1 (Phase II Regional Traffic Impact Fee), and would not change unless a specific increase were formally adopted. CommissiOner Brady pointed out that since Commissioners did have questions regarding this item, it could not be placed on the consent agenda; staff conceded that this was correct, and that the applicant would be notified. This item was continued to June 18, 1998. PUBLIC HEARING - GENERAL PLAN AMENDMENT, AND ORDINANCE AMENDMENT -- CONDITION MODIFICATION A staff report was given recommending denial. Minutes, PC, 6/15/98 Page CommissiOner Brady asked if this item' had been previously presented by the applicant, Staff replied that there had been a similar request for a strip on Stockdale, but could not say if the section in questionwere the same as that which is before the Commission. Staff to investigate and report at a later date. Commissioner Sprague supported denial of this item, stating that such improvement requirements could be passed along unwittingly and unfairly to future title holders of the subject property. Mr. Grady pointed out that after June 18 it would be two weeks before another Commission meeting, stating that a continuation of this item might affect its ability to remain in cycle and indicating that the item might have to be dropPed. Mr. Grady stated that he would research this matter and have the information by the June 18 meeting. CommissiOner Sprague raised the question of any change in school fees due to zoning or Ordinance changes. This item Was continued to June 18, 1998. GENERAL PLAN AMENDMENT CASE NO. P98-0175 '- CITY OF BAKERSFIELD PUBLIC WORKS DEPARTMENT Staff report was given recommending approval. This item Was continued to June 18, 1998. GENERAL PLAN AMENDMENT, CIRCULATION ELEMENT AND RIVERLAKES RANCH SPECIFIC PLAN AMENDMENT CASE NO. P98-0263 - CITY OF BAKERSFIELD Commissioner Dhanens declared a conflict of interest on this item.
