NOTICE OF RIGHT TO APPEAl Planning Commission decisions on Zone Changes, Parcel Maps and Tentative Subdivision maps are subject to appeal by any person aggrieVed. No permit shall be issued for any use involved in an application until after the final acceptance date of appeal. Such appeal must be filed in writing within 10 days from date of hearing, addressed to · the City Council, cio Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $330 non-refundable filing fee must be included with filing of the initial appeal for those appeals filed by the applicant or any person outside the notice area. All appeals filed on land divisions will require a $330 non-refundable filing fee. If all appeals are withdrawn prior to the City Council hearing, it will not be conducted and the decision of the Planning Commission will stand. Hearing on this item was moved to July 2, 1998. REVISED TENTATIVE TRACT 5441 A staff report was given recommending approval with conditions. Commissioner lavorn asked the location of the park nearest this site; staff replied the nearest park was Verdugo, north of the elementary school. Mr. lavom expressed concern that no park was designated in such a large development. Commissioner Brady pointed out that south of the river, parks tended to be smaller and more numerous, that north of the river the parks tended to be larger but fewer in number. Hearing on this item was moved to July 2, 1998. PUBLIC HEARING -- EXTENSION OF TIME --VESTING TENTATIVE TRACT 5594 A staff rePort was given recommending approval with conditions. Commissioner Dhanens asked if the requirement by the Planning Department to maintain a 50-foot dwelling setback would require a modification to a front-yard setback if a home is built on the lots in question. Staff replied that a modification has already been received from the Board of Zoning Adjustment when the tract was first proposed. ,, Hearing On this item was moved to July 2, 1998. Commissioner Tavorn asked if this was the last extension of time available to this particular site; staff replied that the applicant could request one additional year. Hearing on this item was moved to July 2, 1998. PUBLIC HEARING -- EXTENSION OF TIME -- TENTATIVE TRACT 5657 -- OPTIONAL DESIGN A staff rePOrt was given recommending approval with conditions. CommissiOner Tavorn asked if the developer would have to abide by the Hillside Ordinance if the ordinance was approved before this tract goes into development; staff replied that they would be grandfathered. Mr. Tavorn asked if there were any guidelines between the current recommendation and the Hillside Ordinance should there prove to be a large variance between the two; staff replied that the tract would be subject to current conditions, although certain constructiOn elements might be affected by the new ordinance. However, the overall deSign of the tract would not be affected. ? Commissioner Brady asked when the Hillside Ordinance might be approved; staff replied that it had not even been presented to the Commission for consideration. CommissiOner Sprague stated that since the parcel was part of a bank repossession and had not been sold yet,development might be three to four years away.
