NOTICE OF RIGHT TO APPEAL
Planning Commission decisions on Zone Changes, Parcel Maps and Tentative
Subdivision maps are subject to appeal by any person aggrieved. No permit shall be
issued for any use involved in an application until after the final acceptance date of
appeal.
Such appeal must be filed in writing within 10 days from date of hearing, addressed to
the City COuncil, cio Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA
93301. A $330 non-refundable filing fee must be included with filing of the initial appeal
for those appeals filed by the applicant or any person outside the notice area. All
appeals filed on land divisions will require a $330 non-refundable filing fee. If all appeals
are withdrawn prior to the City Council hearing, it will not be conducted and the decision
of the Planning Commission will stand.
If no appeal is received within the specified time period or if all appeals filed are
withdrawn, the action of the Planning Commission shall become final.

ENVIRONMENTAL IMPACT REPORT (DEIR) FOR THE SOUTH BELTWAY
TRANSPORTATION CORRIDOR PROJECT AND SPECIFIC PLAN LINE
The South Beltway Transportation COrridor Project is a Circulation Element Amendment
and Specific Plan Line. It is proposed to preserve a 300-feet-wide-right-of-way
transportation corridor for a freeway alignment.
STAFF RECOMMENDATION: Receive comments and refer to staff.

A staff report was given; staff recommends denial. Staff announced that the emphasis

CommissiOner Boyle asked staff if it was possible to get for the Commission the history
of the original specific plan 10 years ago? Specifically, about what promises were made
to the peoPle on the east side of Coffee by the Planning Commission or City Council.
Staff responded by stating that this has already been looked at and that nothing could be
found in writing relating to this.
CommissiOner Sprague asked Ms. Shaw if when this plan was put together if these
streets were planned for high density residential to come through them and back to the
west instead of coming off Of Coffee? Ms. Shaw responded that Northshore and
.Southshore were planned very early to carry a higher level of traffic than a standard local
street and to her knowledge never into Coffee.
CommissiOner Ortiz asked staff if there has been any kind of dialogue between the three
parties invOlved? Mr. Gauthier responded by stating that to his knowledge there is no
discussion between the two neighborhoods and the developer.

Commissioner Boyle declared a conflict of interest on this project.
A staff report was given; staff stated that there had been a meeting with Castle and
Cooke regarding the park site and have come to a mutual agreement to change the
OS-P zoning to LR.
Commissioner Dhanens wanted to clarify that if the park remained public then it would
be dedicated and developed exactly as its shown now.

- Staff explained that this is a very controversial project and how the next two meetings
........ regarding-this-project-would-be~conducted.-Thursday, night_WoodwardClyde,.the EIR
consultantl would be making a short presentation on environmental impacts and the
process. Ms. Shaw gave a presentation on the project description. '
Commissioner Dhanens asked if Kern County was also going to conduct public hearings
on the adequacy as well, or is the city the sole body? Staff responded that each
"adopting body" would hold hearings on the EIR.
Commissioner Dhanens asked if the October 15 meeting would be open t° public
comments also as the review period does not end until October 19. Staff responded by
stating that it has not been setup that way but it is an option.

Staff informed Commission that the map had recorded and would no longer be
on Thursday night's agenda.

acres, zoned R-1 (One Family Dwelling). (Negative Declaration on file)
A staff report was given, staff recommends a one-year approval.
Action on this item was moved to October 1, 1998.
PUBLIC HEARINGS - TENTATIVE TRACT
Tentative Tract 5921 (Porter Robertson, Eng)
Located west of Calloway Drive, south of Norris R°ad consisting of 196 lots on 57.48
acres zoned R-1 (One Family Dwelling). (Negative Declaration on file)
A staff report was given, staff recommends approval subject to conditions.
Commissioner Sprague asked what kind of fencing was proposed. Staff responded by
stating that the fence would have to be completed by the standards of the Friant-Kern
Water Users Authority who had sent a diagram. Commissioner Sprague asked if the
Commission could ask the developer to build another fence against the fence for the
canal if there were barbed wire on the canal fence. Staff responded in the affirmative.

A staff report was given; staff recommends approval with conditions.
Commissioner Sprague asked if the sites were "environmentally clean." Staff responded
by stating that the City does not take the responsibility to have those reports done but .
the new property owner might be here on Thursday to address that issue.

Commissioner Sprague commented that the Attorney Generals office has put out a
pamphlet called "Conflicts of Interest" and requests that the City purchase a copy for all
of the Commissioners.
