NOTICE OF RIGHT TO APPEAl
Planning Commission decisions on Zone Changes, Parcel Maps and Tentative Subdivision
maps are subjectto appeal by any person aggrieved. No permit shall be issued for any use
involved in an application until after the final acceptance date of appeal.
Such appeal must be filed in writing within 10 days from date of hearing, addressed to the City
Council, c/o Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $334 non-
refundable filing fee must be included with filing of the initial appeal for those appeals filed by
the applicant or any person outside the notice area. All appeals filed on land divisions will
require a $334 non-refundable filing fee. If all appeals are withdrawn prior to the City Council
hearing, itWill not be conducted and the decision of the Planning Commission will stand.
If no appeal is recei~/ed within the specified time period or if all appeals filed are withdrawn, the
action of the Planning Commission shall become final.

Presentation will be made b.y Public Works staff on Thursday, May 20, 1999.
PUBLIC HEARING - VESTING TENTATIVE PARCEL MAP (Martin-Mclntosh)
Vesting Tentative Parcel Map 10465 [Ward 4]
Staff report was given recommending approval with changes in conditions from Public
Works memo dated March 1', 1999.
Commissioner Sprague asked if there is a site plan available for this project to see
where the secondary access road layout goes. Commissioner Sprague stated that he is
not in agreement with vacating a road on the west side of the property without knowing
what's going there (for access purposes).
Mr. Grady said that there is no site plan available.
Commissioner Sprague asked how the Commission could vacate a road without
knowing how the access and everything is going to be in there. Ms. Shaw from the
Public Works Department responded by saying the access to parts of Phase 2 and
Phase 3 are off of Mattingly Street. Parcels in Phase 1 have access off of Lovell
Avenue. They have-a waiver of access to Gosford Road. They only have access from
one direction. Phase 3 will be no different.
Commissioner Sprague said that perhaps the read vacation could be subject to the Fire
Department's approval of a site plan in there at a later date as a possibility of mitigating
the road vacation. Commissioner Sprague thinks the Commission should look at this
and have some discussion.
Commissioner Brady asked if there is going to be an autOmatic right-of-way because of
the railroad tracks and if they needed to move equipment in there, they should be able to
get in that way.
Commissioner Sprague stated thatthe Fire Chief said the Fire Department has to have a
paved road to travel on so consequently you run into a problem with a dirt road. That's
one of the reasons he brought it up.

7.1) Vestincj Tentative Tract Map 5939 (Martin-Mclntosh) [VVard 4]
Staff report was given recommending approval with conditions in Exhibit "A".
There were no comments or questions.

Vesting Tentative Tract Map 5944 (Hershel Moore) [VVard 6]
Staff report was given recommending approval with conditions in Exhibit "A".
The applicant has approved Public Works changes in conditions per their memo
dated May 17, 1999, and request that this be put on the Consent Calender.
Commissioner Sprague asked if the 10-acre park site had already been allocated
in a certain area adjacent to this subdivision?
Jennie Eng stated that there are additional subdivisions in the area that have
requirements for dedication/reservation to finish out the 10-acre park site.
Commissioner Sprague asked if they were going to allocate a portion of land or
are they going to pay their park fees? Ms. Eng responded by saying it was a
combination depending on the subdivision.
CommisSioner Sprague asked if the park location had been determined. Ms.
Eng said 'lyes" it has been determined. Commissioner Sprague asked how the
acreage is being allocated, is it 3.2 acres of this particular subdivision or 3.2
acres of adjacent property?
Jim Movius, Principal Planner, stated that on the east side of Akers Road there is
a tentative tract directly across from this one that also has a requirement to
allocate their proportionate share in a dedication of land and also reserve a
portion for future purchase based on park fees that would be derived from other
subdivisions coming into that area. The property owner for this project owns all
the land down to Taft Highway and has plans to subdivide that in the future and
are aware of their need to allocate as they come in for park acreage on the east
side of Akers Road to make that a 10-acre site which will eventually be across
from the school on the west side of Akers Road.
Commissioner Sprague asked Mr. Movius why there is a need for back-to-back
cul-de-sacs in the project instead of a through road? Mr. Movius stated that it is
strictly the developer's preference. Staff has reviewed the circulation and finds it
adequate with no throughstreets on the cul-de-sacs. The Fire Department also
has looked at the cul-de-sacs and finds no problem with secondary access.

COMMISSION COMMENTS.
Commissioner Sprague asked Mr. Grady to setup a walk through the City departments
so that he and Commissioner McGinnis could meet with staff to get an overview of how
the system works.
Mr. Grady said that he would try to setup something.
