NOTICE OF RIGHT TO APPEAL Planning Commission decisions on Zone Changes, Parcel Maps and Tentative Subdivision maps are subject to appeal by any person aggrieved. No permit shall be iSsued for any use involved in an application until after the final acceptance date of appeal. Such appeal must. be filed in writing within 10 days from date of hearing, addressed to the City Council, c/o Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $334 non-refundable filing fee must be included with filing of the initial appeal for those appeals filed by the applicant or any person outside the notice area. All appeals filed on land divisions will require a $334 non-refundable filing fee. If all appeals are withdrawn prior to the City Council hearing, it will not be conducted and the decision of the Planning Commission will stand. If no appeal is received within the specified time period or if all appeals filed are' withdrawn, the action of the Planning Commission shall become final. Staff is recommending approval with conditions. Public portion of the meeting was opened. No one spoke in opposition. Roger Mclntosh, representing Castle & Cooke, CA, stated that they had reviewed the staff report and concur with the conditions and memorandum dated May 28, 1999, from Public Works, amending condition No. 2. Public portion of the meeting was closed. Commissioner Boyle requested a copy of the memo Mr. Mclntosh referred to. Ms. Shaw responded by saying that copies were not available but that the change was very simple. Condition No. 2 in the Public Works conditions did read "there shall be a minimum of 22 feet between the median curbs and the flowline" and after discussion and agreement with Mr. Mclntosh, now states "there shall be a minimum of 36' from flowline to flowline. Provision must be made for vehicle turn around in front of the private gates." Motion was made by Commissioner Kemper, seconded by Commissioner Boyle, to approve Vesting Tentative Tract Map 5290, Second Revision, with findings and conditions as set forth in the attached resolution Exhibit "A" with the change as stated by Ms. Shaw in the memorandum dated May 28, 1999, item 2. Motion carried. Vesting Tentative Tract Map 5822 (Martin-Mclntosh)- Ward 4) Staff report was given. Staff is recommending approval with conditions and memo from Public Works Department dated May 28, 1999. Ms. Shaw stated that there were no copies of the memo to pass out but Public Works Condition No. 2 in relationship to the private entry street has been changed. It now says "in the private entry streets, there shall be a minimum of 20 feet between the median curbs and the flowline as shown on the tentative map." Public portion of the meeting was opened. (WardS) See consent 'agenda. WORKSHOP BY CARL HERNANDEZ REGARDING CONFLICT OF INTEREST: Carl Hernandez, Deputy City Attorney, gave an overview presentation regarding conflict of interest. He stated that any conflict of interest with regards to specific factual situations are contingent upon the facts that are. at issue. Commissioner Sprague asked Mr. Hernandez if on real estate sales purchase contracts, you had sold a piece of property to a buyer one year ago and that buyer then brings through his engineer a tract map for Planning Commission approval, would it be a conflict of interest after a year's time? Mr. Hernandez stated that it was not likely because it was longer than 12 months. If yoU were still entitled to further payment, then there would be a potential conflict. Mr. Hernandez stated that he would be glad to answer any questions the Commissioners might have but to please understand that the questions they ask regarding conflicts of interest should be given to the Attorney's office well in advance of the decision that they are going to make and also if its complex and the Attorney's office cannot give a firm answer, if it appears that they need to contact the FAPC, they will assist the Commissioners in doing that. Commissioner Sprague stated that he attended the Monterey Planning Commissioner's conference and purchased the videos regarding the Brown Act and conflict of interest and offered to loan them to the other Commissioners. There were no written or verbal communications. COMMISSION COMMENTS. Commissioner Sprague mentioned that he had just learned that Marc Gauthier was undergoing treatment and wanted him to know that their prayers are with him. Commissioner Tkac mentioned that the California Women for Agriculture had faxed the Commissioners an invitation to attend an agricultural tour on June 25 for State legislators, City, County and appointed officials. He wanted to encourage everyone to attend this function. He stated it was a lot of fun and you learn a lot about agriculture and Kern County. Commissioner Sprague asked if this would be a conflict regarding the Brown Act? Mr. Hernandez stated you cannot attend a meeting of the full body where there will be discussions of matters that pertain to items that the Commission may have jurisdiction over. Mr. Hernandez said that he can provide an opinion of what the Commission can and can't do while attending the meeting. DISCUSSION AND ACTION REGARDING POSSIBLE CANCELLATION OF NEXT PRE-MEETING. Because of it being general plan amendment hearings on Thursday, June 17, 1999, it was decided that there will be a pre-meeting on June 14, 1999. ADJOURNMENT.
