NOTICE OF RIGHT TO APPEAL Planning Commission decisions on Zone Changes, Parcel Maps and Tentative Subdivision maps are subject to appeal by any person aggrieved. No permit shall be issued for any use involved in an application until after the final acceptance date of appeal. Such appeal must be filed in writing within 10 days from date of hearing, addressed to the City Council, cio Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $334 non-refundable filing fee must be included with filing of the initial appeal for those appeals filed by the applicant or any person outside the notice area. All appeals filed on land divisions will require a $334 non-refundable filing fee. If all appeals are withdrawn prior to the City Council hearing, it will not be conducted and the decision of the Planning Commission will stand. If no appeal is received within the specified time period or if all appeals filed are withdrawn, the action of the Planning Commission shall become final. PUBLIC HEARING - Revocation of a waiver of direct access to Truxtun Avenue for Parcel Map 9299 (Dewalt Corp.) Staff report recommending approval including conditions from the Public Works Department was given. Commissioner Sprague questioned the access right onto Truxtun. Commissioner Sprague wanted to know if Steve Walker, Traffic Engineer, has looked at and approved this project. Ms. Shaw said that Steve Walker reviewed the project and the recommendations came from the Traffic Division of Public Works. Commissioner Sprague asked if there has been a traffic study? Ms. Shaw said she didn't think so. He requested a traffic count on the eastbound portion of Truxtun Avenue for Thursday night and would like to hear from Steve Walker that night about the safety issue on eastbound traffic at that particular point of intersection. Commissioner McGinnis stated that he shared the feelings of Commissioner Sprague along the Truxtun corridor. Commissioner McGinnis asked Ms. Shaw if there is an existing median going through Truxtun Avenue? Ms. Shaw said that there is no median at this time but one of the recommendations placed on this project is to construct a median to restrict the turn moves at that location. Commissioner McGinnis asked if that would also restrict people from exiting onto Truxtun Avenue and crossing the lanes of traffic? Ms. Shaw said it would be restricted to right turn in, right turn out and left turn in - no left out - so they cannot cross Truxtun and go westbound. Commissioner Brady stated that the first phase of the Kern River Freeway is going to dump onto Rosedale and he thinks Truxtun. He requested that on Thursday night the Commission be provided some information about where that interchange will take place and how close it is to this project? Commissioner Sprague aSked if the parcel running adjacent to Truxtun is the same owner as the subject parcel they are speaking of? Ms. Shaw said they are different owners. Stanley Grady, Planning Director, asked the Commission if they wanted this item on the consent calendar? Chairman Dhanens responded by saying that based on the questions they had today, he didn't believe it should go on the consent calendar. Item will be heard on Thursday, August 19, 1999. PUBLIC HEARINGS - EXTENSIONS OF TIME 6.1) Tentative Tract 5441 Revised (Porter-Robertson Engineering) (Ward 4) Staff report recommending approval as was originally approved was given. (Ward 4) Staff report recommending approval of a two year extension of time was given. Commissioner Sprague said the map did not show Noriega Road continuing on the back side and wondered if that was something that was coming in the future or does it exist already? Ms. Shaw said that she believes it exists now. There were no other Commissioner comments or questions. Item will be voted on the Consent Agenda on Thursday, August 19, 1999. 6.3) Tentative Tract 5596 (Porter-Robertson Engineering) (Ward 4) Staff report recommending al:iproval of a two year extension of time was given. PUBLIC HEARINGS - TENTATIVE TRACT MAP-~ 7.1) Revised Vesting Tentative Tract 5529 (Simpson-Lusich-VanCuren) (Ward 6) Staff report recommending approval with conditions shown in the resolution was given. The applicant has requested to be placed on the Consent Agenda for Thursday night. There were no Commissioner comments or questions. Item will be voted on the Consent Agenda on Thursday, August 19, 1999. 7.2) Vesting Tentative Tract 5954 (Martin-Mclntosh) (ward 4) Staff report recommending approval of all the requests for modifications was given. Staff is also recommending that the subdivider dedicate their proportionate share of the six acre park which is located south of this tract. The applicant has provided written agreement to all the conditions of approval and has requested to be placed on the Consent Agenda for Thursday. Commissioner Brady stated that in a prior tract map the Commission approved a street length longer than 1,000 feet and wanted to know if they are asking for one 2,500 feet and whether the Commission ever approved one that long? Minutes, PC, Monday, August 16, 1999 Page 4 Mr. Grady said that he was not sure what the maximum length is of a street the Commission has approved. He said they could find out by Thursday. Commissioner Brady wanted to know if the curb and the length and width of the street will slow traffic down? And, does a street that long have secondary access problems? Commissioner Brady said that if the Fire Department and Traffic Department has signed off on it, then it must be o.k. and he will too. Commissioner Sprague commented that to answer Mr. Brady's question, that these are unique parcels in that they are abutting the golf course so they are trying to clean the area up to move smoothly and to put secondary streets and shorten those roads would pull away from the aesthetics of being on the g01f course. Item will be voted on the Consent Agenda on Thursday, August 19, 1999. 7.3) Vesting Tentative Tract 5955 (Martin-Mclntosh) (Ward 4) Staff report recommending approval of all the requests for modifications including the two conditions related to Tract 5955 regarding zoning and the Canfield Ranch Oil Field was given. Staff is also recommending that the subdivider dedicate their proportionate share of the six acre park which is located south of this tract. The applicant has provided written agreement to all the conditions of approval and have requested to be placed on the Consent Agenda for Thursday. Item will be voted on the Consent Agenda on Thursday, August 19, 1999. 7.4) Vesting Tentative Tract 5957 (SmithTech USA, Inc.) (Ward 4) The applicant is requesting a continuance of this project so it may be heard at the same time Vesting Tentative Tract Map 5951 is heard. The request for continuance until September 2, 1999, will be voted on the Consent Agenda on Thursday, August 19, 1999. 7.5) Vesting Tentative Tract Map 5951 (SmithTech USA Inc) (Ward 4) Because this cannot be approved until after the Council hears the general plan amendment which has been continued until November, staff is recommending continuance of this particular tract to aliow the applicant to make some revisions to the tract to accommodate that continuance. This will be readvertised and placed on the September 2, 1999, meeting. The request for continuance until September 2, 1999, will be voted on the Consent Agenda on Thursday, August 19, 1999. Minutes, PC, Monday, August 16, 1999 Page 5 10. PUBLIC HEARING - ORDINANCE AMENDMENT (All wards) Staff report recommending approval was given by Mr. Grady. Commissioner Sprague asked what kind of problems have we had with it the way it is without changing it? Mr. Grady said that incomplete design programs are'submitted and it causes the developer to pay more money. Commissioner Sprague asked if this would be a combining zone or a "D" zone? Mr. Grady said that it is an amendment to those two zones to provide for the combining feature as part as the PUD/PCD zone. Commissioner Sprague also asked if when an application for approval is made staff would recommend this type of zone because of the peculiarness of the project? Mr. Grady said that if it is a situation where staff could not recommend a straight C-2 or C-1 zone because of some particular sensitive uses around it or some other community concerns that have been brought to the Planning Department's attention during the review of the project, staff would propose one of the two alternatives to the Commission. Commissioner Brady asked Mr. Grady if the Cooper Nursery property is an example of what he is talking about? Mr. Grady said that that is correct. This will take place prior to the issuance of a building permit. The property owner would have to submit his site plan to the Planning Commission for review in a public hearing. Commissioner Brady asked if there always will be the option of the combined zone. Mr. Grady said yes. Commissioner Dhanens asked if in the zone map it would be listed as a C-2 with a PCD written under it? Mr. Grady said yes it would show PCD/C-2 or whatever is appropriate. Commissioner Dhanens asked Mr. Grady if the city used combining districts now? Mr. Grady said no that site plan review replaced what used to be an overlay district. Commissioner Brady asked if there has been any input from BIA or other industry representatives about this change? Mr. Grady said that he hadn't received any input nor- is he aware of staff receiving any but they all have received copies of the ordinance. This item will be heard on Thursday, August 19, 1999. COMMUNICATIONS. There were no written or verbal communications. COMMISSION COMMENTS. Commissioner Brady mentioned the Subdivision Committee was meeting on Wednesday.
