NOTICE OF RIGHT TO APPEAl
Planning Commission decisions on Zone Changes, Parcel Maps and Tentative
Subdivision maps are subject to appeal by any person aggrieved. No permit shall be
issued for any use involved in an application until after the final acceptance date of
appeal.
Such appeal must be filed in writing within 10 days from date of hearing, addressed to
the City Council, c/o Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA
93301. A $334 non-refundable filing fee must be included with filing of the initial
appeal for those appeals filed by the applicant or any person outside the notice area.
All appeals filed on land divisions will require a $334 non-refundable filing fee.. If all
appeals are withdrawn prior to the City Council hearing, it will not be conducted and the
decision of the Planning Commission will stand.
If no appeal is received within the specified time period or if all appeals filed are
withdrawn, the action of the Planning Commission shall become final.

Staff report given recommending approval with conditions attached to Exhibit

Roger Mclntosh, representing the City of Bakersfield and the County of Kern,
stated that he had read the conditions of approval with his clients and they
concur with the staff report as written and also to inform the Commission that
the purpose of this parcel map is also to vacate the public streets that are
running through the site and to cleanup the individual parcel lines so that a
building is not built across any of the parcels.
Public portion of the meeting was closed.
Motion was made by Commissioner Sprague, seconded by Commissioner
McGinnis, to approve and adopt the negative declaration to approve Vesting
Tentative Parcel Map 10587 with the findings and conditions set forth in
attached resolution Exhibit "A"
Motion carried.
6.2) Vesting Tentative Parcel Map 10668 (Mclntosh & Associates) (Ward4)
Staff report given recommending approval with conditions attached to resolution
and memo with revised conditions from the Public Works Department dated '
February 3, 2000.
Public portion of the meeting was opened. No one spoke in opposition.
Roger Mclntosh, representing Castle and Cooke, CA Inc., stated that they have
reviewed the conditions, met with staff, and agree with the staff report with the
revisions per the memo dated February 3, 2000, from Marian Shaw in the Public
Works Department.
Public portion of the meeting was closed.
Commissioner Brady asked Ms. Shaw if she Would explain the purpose of the
memorandum. Ms. Shaw said that basically the purpose of the memorandum
was to change the conditions reflected in requiring "not a part" be a designated
remainder when originally they had asked for it to be included within the
boundary of the subdivision as a parcel. Commissioner Brady then asked why
they changed their mind? Ms. Shaw said that discussion with her boss with
regards to the definition of "designated remainder" and the meaning of "for
sale, lease or finance" whether now or in the future.
Commissioner Brady asked about Condition No. 2 and what that means. Ms.
Shaw stated that the original condition stated all of Buena Vista and all of Ming
Avenue and now it reads the borders of Parcel No. 1. Ms. Shaw said there will
be no narrow portion of Buena Vista.
Commissioner Brady questioned Condition No. 5 and asked why that one
changed. Ms. Shaw said that what was there required a higher wattage and
the General Services Department is contemplating a change to a higher wattage

but since it has not been circulated and approved yet as a change to standards,
and since this is a vesting map they can't make this a condition but they have
agreed to use the "standards" which are used throughout the city.
Commissioner Sprague asked if staff knew what will be built on this property?
Mr, Grady said that the property is zoned C-2 so there is no requirement that
they submit a site development proposal that would come back to the Planning
Commission. The site would be developed through the site plan review
process.
Motion was made by Commissioner Brady, seconded by Commissioner
Sprague, to approve and adopt the negative declaration to approve Vesting
Tentative Parcel Map 10668 with the findings and conditions set forth in
attached resolution Exhibit "A" as modified by the February 3, 2000,
memorandum from Marian P. Shaw to the Planning Commission.
Motion carried.

Mr. Grady introduced the Commission to a new member of the staff, Jake Sweeny,
who will be presenting subdivisions in the future.
COMMISSION COMMENTS.
Commissioner Sprague asked if the Public Works Department could check into the
brackish water that is coming through the Cai Water System and if there is a way to
filter the lines so that the residents are not getting the brackish water? Ms. Shaw said
she will ask.
Commissioner Boyle asked if the Grand Canal project was a Planned Commercial
Development? Mr. Grady said that it is a PCD and would have to come back to the
Commission if there were going to be any bhanges to it.
