NOTICE OF RIGHT TO APPEAl Planning Commission decisions on Zone Changes, Parcel Maps and Tentative Subdivision maps are subject to appeal by any interested p(~rson adversely affected by the decision' of the Commission. No permit shall be issued for any use involved in an application until after the final acceptance date of appeal. The appeal shall include the appellant's interest in or relationship to the subject property, the decision or action appealed and shall state specific facts and reasons why the appellant believes the decision or action of the Commission should not be upheld. Such appeal must be filed in writing within 10 days from date of hearing, addressed to the. City Council, c/o Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $334 non- refundable filing fee must be included with filing of the initial appeal for those appeals filed by the applicant or any person outside the notice area. All appeals filed on land divisions will require a $334 non-refundable filing fee. If all appeals are withdrawn prior to the City Council hearing, it will not be conducted and the decision of the Planning Commission will stand. PUBLIC HEARING - Extension of Time for Tentative Parcel Map 10347 (Alta Engineering/Hughes Surveying) (Ward Staff report given recommending approval of a two year extension of time. Public portion of the hearing was opened. There were no Commission comments or questions. This item is on the consent calendar and will be voted on Thursday night. PUBLIC HEARINGS - Tentative Parcel Maps 5.1 Revised Vesting Tentative Parcel Map 10465 (Mclntosh & Associates) (Ward 6) Staff report given recommending the Commission choose one of two options to approve the project. The first option would include a motion to add one of the three conditions mentioned in the memo from the Planning Department that staff prepared for today's meeting. The second motion would be not to add any additional conditions and rely on existing regulations to mitigate the potential for impact. Public portion of the hearing was opened. Commissioner Brady asked if the applicant has indicated which of the options he would prefer? Mr. Grady said that he spoke with Mr, Mclntosh last week and he has some similar language that provides for restrictive covenant on the property along District and he supplied it to Mr. Grady, Mr. Grady said he could supply that to the Commission before Thursday. Mr. Grady said that Mr. Mclntosh is favoring putting some kind of deed restrictions on the uses along Gosford. Commissioner Sprague asked if the deed restriction would also include agricultural storage of chemicals and pesticides as well as chlorine gas? Mr. Grady said the wording was just identifying potential uses. The Commission may be more precise when the condition is formed as to what they want to deed restrict for those properties along Gosford. Commissioner Sprague asked if the Fire Marshal could comment Thursday night about perhaps leaving it to his purview to review items within this area as far as hazardous materials? Mr. Grady said that he would ask the Fire Marshal to attend the meeting on Thursday. Commissioner Sprague asked if the owners are responsible for the landscape maintenance, how would the City control the maintenance of the landscaping? Mr. Grady said there would have to be some language added requiring some uniform ownership of the easement and some uniform maintenance of the Minutes, PC, December 4, 2000 Page 3 easement that would be placed as conditions on the other prOperties that would either be fronting Gosford or within the entire map. That would be something that would have to be developed. Staff has not identified language for something like that. Commissioner Dhanens asked if on the west side of the map (Progress Road) there will be the same considerations as what is proposed for Gosford Road as there is R-1 zoned property across the street? Mr. Grady said his discussion only related to the properties along Gosford but that is certainly a real issue that could be addressed on Thursday night. Commissioner Sprague asked if it is the developer's responsibility to put the sidewalks in when the phase is recorded or is it the potential buyer's responsibility to put the sidewalk in when they do the site plan? Mr. Grady said that typically those improvements are put in as each parcel is developed. There were no other Commission comments or questions. Item was continued until Thursday night. 5.2 Tentative Parcel Map 10719 (Porter/Robertson) (Ward 6) Staff report given recommending approval subject to the conditions. Commissioner Dhanens asked Ms. Shaw if they have access anywhere along White Lane or is it restricted to certain areas? Ms. Shaw said that most of White Lane does have a waiver of access along the south side. This particular site has one area where the waiver is not required. They vacated it sometime ago. This parcel map does have one access point to White Lane. Commissioner Dhanens asked if a use developed on parcel one would have direct access from White Lane? Ms. Shaw said "no." Commissioner Brady asked if there is any problem with parking and access for the various parcels? Mr. Grady said the actual parking would be based on the use. The access easement would be jointly used. The site plan review stage is when the parking will be considered. There were no other Commission comments or questions. Item was continued until Thursday night. 5.3 Vestin_~ Tentative Parcel Map 10723 (Mclntosh & Associates) (Ward5) Staff report given recommending approval. Minutes, PC, December 4, 2000 Page 4 Commissioner Sprague asked what guarantee the city has that the frontage medians and the landscaping on these parcels will be maintained by the separate owners of these parcels? Mr. Grady said he would have staff give him an answer to this question Thursday night. There were no other Commission comments or questions. Item was continued until Thursday night. 5.4 Tentative Parcel Map 10748 (PortedRobertson) (Ward 5) Staff report given recommending approval and the applicant has requested this be placed on the consent calendar for Thursday night. The applicant has agreed to the conditions of approval. Commissioner Sprague asked if there is a wall required along the east line of parcel B and parcel 3 to separate it from the commercial? Mr. Grady said "no." Commissioner Sprague asked if there is an easement between parcel 3 and parcel B to the north? Mr. Grady said there is not. They are separate parcels. There were no other Commission comments or questions. Item was continued until Thursday night. PUBLIC HEARINGS - Tentative Tract Maps 6.t) Vesting Tentative Tract 6017 (Porter-Robertson) (Ward 4) The applicant is requesting this item be continued until January 18, 2001. · Commissioner Dhanens'declared a conflict of interest on this project. There were no Commission comments or questions. The request for continuance will be voted on the consent calendar on Thursday night. 6.2 Vesting Tentative .Tract 6032 (SmithTech USA, Inc) (ward 4) Staff report given recommending approval of the reverse corner lots proposed in the subdivision and also the less than standard curb radii and with the conditions attached to the resolution. The applicant requested this item be placed on the consent agenda for Thursday night. There were no Commission comments or questions. Item will be added to the consent calendar for Thursday night. COMMUNICATIONS Mr.' Grady announced there is a consistency finding item that needs to be placed on the agenda ThurSday night. It is for land to be acquired to construct an interchange at 178 and Fairfax. Commissioner Sprague asked for a plat for Thursday night. He also mentioned that there is a lot of dumped concrete on the site and wondered who had to clean it up? Mr. Grady said he would find out by Thursday.
