A RESOLUTION DETERMINING THAT THE
REPAIR, REPLACEMENT, AND RENOVATION OF
THE MCMURTREY AQUATIC CENTER
WATERSLIDE STRUCTURE CANNOT BE
REASONABLY OBTAINED THROUGH THE USUAL
BIDDING PROCEDURES AND AUTHORIZING THE
FINANCE DIRECTOR TO DISPENSE WITH
BIDDING THEREFOR AND REQUEST WATERSLIDE
STRUCTURE REPAIR, REPLACEMENT, AND
RENOVATION SERVICES FROM WHITEWATER
WEST INDUSTRIES, LTD., NOT TO EXCEED
$789,675.
WHEREAS, the City desires the repair, replacement, and renovation of the
waterslide structure at the McMurtrey Aquatic Center to be performed by
WhiteWater West Industries, Ltd.; and
WHEREAS, WhiteWater West Industries, Ltd. was the original waterslide
provider and installer of the waterslide structure at the McMurtrey Aquatic Center;
and
WHEREAS, WhiteWater West Industries, Ltd. has the materials, supplies, and
personnel available to meet the City's necessity for the successful integration of the
repair, replacement, and renovation of the waterslide structure at the McMurtrey
Aquatic Center so as to restore it to its original condition; and
WHEREAS, the Recreation and Parks Director recommends the City Council
find that said McMurtrey waterslide structure can only be reasonably repaired,
replaced, and renovated by WhiteWater West Industries, Ltd. because of the
necessity to successfully incorporate specialized design and construction methods
to successfully repair, replace, and renovate the City's existing waterslide structure,
and that the Council authorize dispensing with bidding requirements in
accordance with subsection D.2 of Section 3.20.060 of the Bakersfield Municipal
Code.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
The above recitals are true and correct and incorporated herein by
reference.
2. The work, supplies, equipment or materials can only be reasonably

obtained from one vendor because of restricted availability of such work, supplies,
equipment or materials.
3. The Finance Director is authorized to dispense with bidding in
accordance with Section 3.20.060 of the Bakersfield Municipal Code.
4. The expenditure of funds for said work, supplies, equipment or materials
shall not exceed $789,675.
