A RESOLUTION DETERMINING THAT CERTAIN
SCHWARZE INDUSTRIES, INC. EQUIPMENT
PARTS CANNOT BE REASONABLY OBTAINED
THROUGH THE USUAL BIDDING PROCEDURES
AND AUTHORIZING THE FINANCE DIRECTOR
TO DISPENSE WITH BIDDING THEREFORE AND
PURCHASE SCHWARZE INDUSTRIES, INC.
EQUIPMENT PARTS THROUGH MUNICIPAL
MAINTENANCE EQUIPMENT, NOT TO EXCEED
$450,000 OVER A THREE -YEAR TERM.
WHEREAS, CITY is in need of new and replacement Schwarze Industries, Inc.
equipment parts; and
WHEREAS, City currently has 10 pieces of Schwarze Industries, Inc. equipment
in service as part of the City's active fleet; and
WHEREAS, the parts necessary to maintain and repairthe Schwarze Industries,
Inc. equipment can only be obtained through a Schwarze Industries, Inc. distributor;
and
WHEREAS, Schwarze Industries, Inc. equipment parts can only be acquired
through the authorized California distributor, Municipal Maintenance Equipment,
and
WHEREAS, it is necessary to purchase Schwarze Industries, Inc. equipment
parts because of the inability to interchange any other part manufactured by
another company.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
The above recitals are true and correct and incorporated herein by
reference.
2. As the sole California distributor, the equipment can only be
reasonably obtained from one vendor, Municipal Maintenance Equipment,
because of the need to successfully repair such equipment that are already in
operation within the City system.
3. The Finance Director is authorized to dispense with bidding in
accordance with Section 3.20.060 of the Bakersfield Municipal Code. tinKFq

4. The expenditure of funds for said parts shall not exceed Four Hundred
Fifty Thousand Dollars ($450,000) over a three -year term.
I HEREBY CERTIFY that the foregoing Resolution was passed and

This letter is to certify that Municipal Maintenance Equipment, located in Sacramento, Hayward,
Redding, and Placentia, CA is the authorized dealer for sales and service of Schwarze Industries' line of
Street Sweepers, Road Patcher, and Spray Patcher equipment for the City of Bakersfield, CA. The use of
non OEM parts could result in voiding any and all current warranties you may have on your Schwarze
products.
