AMENDMENT NO. 1 TO RESOLUTION NO. 277 -D4
REGARDING THE DISABILITY RETIREMENT
PROCEDURES FOR SAFETY MEMBERS.
WHEREAS, on October 20, 2004, the City council adopted Resolution No.
277 -04 modifying the disability retirement procedures for safety members; and
WHEREAS, the Disability Retirement Review Committee for Safety Members
( "Committee ") consists of three members: the appropriate department head,
i.e. the Fire Chief or Police Chief; a representative from the Human Resources
Division, and a representative from the Risk Management Division; and
WHEREAS, the Risk Management Division coordinates the hearings,
corresponds with disability applicants, and provides the Committee with
medical information; and
WHEREAS, due to the role of the Risk Management Division in the disability
retirement process, described above, replacing the Risk Management Division
position on the Committee with a representative from the City Manager's Office
will allow the Risk Management Division to focus on presenting applicable
information to the Committee and advocating for the City's position; and
WHEREAS, the City Council desires to amend Resolution No. 277 -04 to
remove the Risk Management Division from the Committee and include a
representative from the City Manager's Office on the Committee.
NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED by the Council of
the City of Bakersfield as follows:
The above recitals are true and correct.
2. Resolution No. 277 -04 is hereby amended to read as follows:
B. Said Committee shall consist of:
The appropriate department head,
i.e., Fire Safety member - Fire Chief,
Police Safety member - Police Chief;
2. Two representatives from the City
Manager's Office, one of which is
from the Human Resources Division.

3. Except as amended herein, all other provisions of Resolution No.
277 -04 shall remain in full force and effect.
4. This Resolution shall take effect immediately upon its passage.

HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on
