The State Water Resources Control Board (SWRCB) has revised the City’s water conservation goal. After reviewing Bakersfield’s population growth and other climate-related factors, the SWRCB has revised the City’s domestic area water conservation goal to now 31% (formerly 36%). The new target became effective March 1, 2016. Even with this good news, we encourage residents to please remain prudent in their water conservation efforts.  A large piece of steel from the World Trade Center that will be used as a 9/11 memorial centerpiece arrived earlier this week. This privately funded memorial will be located between the Bakersfield Fire Department Fire Station #15 and the Bakersfield Police Department Substation at 1315 Buena Vista Road. The memorial is scheduled to open on September 11th.  The City has been selected as the Employer of the Year by the local Employment Development Department (EDD); specifically, for our efforts to employ and include veteran candidates in workforce development activities. Also, EDD has attributed this award for the BPD’s ongoing efforts to attract veteran candidates. Additional information regarding an award ceremony will be provided in the future. General Information April 8, 2016 Page 2  Construction continues at the Mill Creek Village located at 518 18th Street. This 62- unit affordable senior housing project and parking structure is scheduled for completion in January 2017. In addition to increasing the supply of quality affordable housing for seniors, the project complements the continuing revitalization of the Mill Creek area in downtown Bakersfield.  Congratulations to Assistant Police Chief, Lyle Martin, and his partner, Marnie Forzetting, for beating out nine other teams in the local dance competition, “Dancing at the Stars.” This fundraising event raised about $35,000 for the Stars Theatre, which is a downtown theatre that trains local performers. Traffic and Other Road Advisories In the event of inclement weather or other unforeseen circumstances, this work may be rescheduled to a later date.  Rosedale Highway Median Work Begins The contractor for the Rosedale Highway Widening Project has moved traffic to the outside lanes of the highway and started trenching for the future median along the roadway. This has eliminated left turns from Rosedale Highway to and from side streets between Kilmer Way (refinery access road) and Gibson Street since these crossings are now under construction. Motorists can make U-turns at Mohawk and Gibson Streets to access the side streets from the opposite side of the highway in this area.  Lane Closures Planned for Southbound State Route 99 near Rosedale Highway The contractor plans to install shoring for a new retaining wall located along southbound State Route 99 near Gilmore Avenue. The work will require the closure of the two outside southbound lanes on State Route 99, between Gilmore Avenue and Rosedale Highway. The contractor may also need to close the southbound Rosedale Highway off-ramp during this period. This work is expected to be General Information April 8, 2016 Page 3 conducted during nighttime hours, Sunday through Thursday, and closures are expected to be in place between 9:00 p.m. and 5:00 a.m. During the ramp closure, southbound State Route 99 motorists who want to access Rosedale Highway or 24th Street will need to continue southbound and exit at California Avenue then return via northbound State Route 99 to the Rosedale Highway/24th Street exit.  Earthwork Continues Along State Route 178 – Short Delays Anticipated The contractor for the State Route 178 Widening project continues to perform earthwork activities along State Route 178, between Canteria Drive and Masterson Street. The contractor is moving dirt off the job site and flagging personnel will need to stop traffic when trucks enter and exit the job site, and during the loading process. Traffic may be stopped for up to 10 minutes between the hours of 8:00 a.m. and 4:00 p.m., affecting both directions of travel. Motorists are advised to use alternate routes or to allow sufficient time to reach their destinations while this work is underway.  Centennial Corridor Utility Potholing Schedule for the Week of April 11, 2016 The Centennial Corridor design team will continue potholing operations next week to verify existing utilities located along the corridor. Potholing operations entail making a small hole and vacuuming out dirt to allow buried lines to be identified, then replacing the dirt and restoring the ground surface. Approximately 200 locations have been identified for potholing. The contractor plans to have two trucks in operation Mondays through Thursdays, through May 7th. Crews are expected to be in the field between the hours of 7:00 a.m. and 5:00 p.m. each work day. Lane or shoulder closures will be in place as necessary while work is underway. From April 11th through the 14th, the contractor plans to operate at the locations, as follows: o Along California Avenue, between Easton Drive and Del Rey Court; o On Del Rey Court, between the cul-de-sac at California Avenue and Montclair Street; o On Elcia Drive, east of South Real Road; o Wible Road, just south of the State Route 99 off-ramp to Stockdale Highway; and o At the Stockdale Highway and Enos Lane (SR 43) intersection. AT:cg cc: Department Heads Roberta Gafford, City Clerk OFFICE OF THE CITY MANAGER MEMORANDUM April 4, 2016 TO: Alan Tandy, City Manager AT FROM: Chris Huot, Assistant City Manager CH SUBJECT: Referral of Budget Discussions to Budget and Finance Committee Council Referral No.690 Councilmember Maxwell referred discussion of future adjustments to the City’s budget be reviewed by the Budget and Finance Committee. During the March 30, 2016 City Council meeting, Councilmember Maxwell requested the Budget and Finance Committee review future potential budget adjustments as a result of the ongoing negative sales tax trending. City Council Policy Resolution No. 81-97 (enclosed) provides the framework for the budget process. The policy states, in part, “1. The City Manager shall provide to the full City Council an overview of the City’s fiscal position and the proposed budget for the upcoming fiscal year [emphasis added].” The resolution was adopted after a time period when the Budget and Finance Committee reviewed the budget prior to the full City Council. The City Council majority felt the subject was of such importance that the full Council should receive the same information at the same time. The discussion of the impacts of the negative sales tax trending is directly tied to the City’s fiscal position and the budget currently being prepared for the upcoming fiscal year. As such, staff intends to comply with Resolution No. 81-97 and provide the full City Council with an overview of the FY 16-17 Proposed Budget and associated impacts at the City Council meeting of May 4th. M E M O R A N D U M CITY ATTORNEY’S OFFICE April 4, 2016 TO: HONORABLE MAYOR AND CITY COUNCIL FROM: JOSHUA H. RUDNICK, DEPUTY CITY ATTORNEY SUBJECT: CONTINUAL UPDATES ON SB 5 REGARDING E-CIGARETTES COUNCIL REFERRAL NO. 692 On March 10, 2016, SB 5 was ordered to “engrossing and enrolling,” which means that both Houses are proofreading the final copy of the Bill before it is sent to the Governor’s desk. Previously, the Senate had passed the Bill as amended and it was passed by the Assembly. A copy of the City Council Resolution in support of SB 5 will be sent to the Governor’s office as well. Our office will continue to monitor the Bill’s status. As requested, attached you will find a copy of the City’s resolution in support of SB 5, which was previously approved on March 30, 2016. RESOLUTION NO. 041— 1 6 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD IN SUPPORT OF SENATE BILL 5 REGARDING E- CIGARETTES WHEREAS, Senate Bill 5 (Leno) was amended and passed in the Assembly, and is currently pending in the Senate; and WHEREAS, SB 5 broadens the definition of "smoking" under the state law to include the use of an electronic smoking device that creates an aerosol or vapor, in any manner or in any form, or the use of any oral smoking device for the purpose of circumventing the prohibition of smoking; and WHEREAS, SB 5 expands the definition of "tobacco product' under state law to include an electronic device that delivers nicotine or other vaporized liquids to the person inhaling from the device, including, but not limited to, an electronic cigarette, cigar, pipe, or hookah; and WHEREAS, SB 5 exempts from the definition of "tobacco product' a product that has been approved by the U.S. Food and Drug Administration FDA) for sale as a tobacco cessation product or for other therapeutic purposes where the product is marketed and sold solely for such an approved purpose; and WHEREAS, SB 5 requires retailers of cigarettes and tobacco products, including electronic cigarettes, to apply for a license and pay a license fee in the amount of $265.00, beginning January 1, 2017; and WHEREAS, SB 5 requires all cartridges for electronic cigarettes and solutions for filling or refilling an electronic cigarette to be in child- resistant packaging, as defined by the Code of Federal Regulations; and WHEREAS, SB 5 makes selling or furnishing tobacco products, including electronic cigarettes, to a minor a misdemeanor; and WHEREAS, SB 5 provides that minors smoking tobacco products, including electronic cigarettes, are subject to a fine of $75.00 or 30 hours community service; and WHEREAS, SB 5 prohibits the selling, advertising, or furnishing of tobacco products, including electronic cigarette products, to persons under 21 years old; and Page 1 of 3 Pages - ° Fri ORIGIN/4L WHEREAS, SB 5 makes it illegal for the purchasing of tobacco products, including electronic cigarettes, by persons under 21 years old; and WHEREAS, If the bill passes as drafted, smoking electronic cigarettes will be prohibited at schools, healthcare facilities, public buildings, playgrounds (parks and recreational areas), and certain housing facilities because of the inclusion of electronic cigarettes in the definition of smoking.
