HomeMy WebLinkAboutRES NO 131-02RESOLUTION NO. 1[ 3~"0~ RESOLUTION DETERMINING THAT RAISING THE DAKTRONICS ELECTRONIC MESSAGE CENTER SIGN ON TRUXTUN AVENUE AT CENTENNIAL GARDEN ARENA CANNOT BE REASONABLY OBTAINED THROUGH THE USUAL BIDDING PROCEDURES AND AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH BIDDING THEREOF, NOT TO EXCEED $37,500. WHEREAS, the existing Daktronics electronic message center sign was installed with the construction of Centennial Garden Arena; and WHEREAS, the trees along Truxtun Avenue in front of the Arena were planted at the same time; and WHEREAS, said trees have now grown to a height that obstructs the wew of the sign; and WHEREAS, the City has determined that the sign can be raised to a height that will provide visibility above the trees; and WHEREAS, the City waives the height limit for this sign, and WHEREAS, City Neon Sign Systems originally installed the sign manufactured by Daktronics, and whereas City Neon is the authorized distributor of Daktronics, they can perform the work to raise the sign while still maintaining the electronic warranty on the sign; and WHEREAS, the Finance Director has determined, and has recommended the Council find, that the raising of the Daktronics electronic message center sign can only be obtained from one vendor, City Neon Sign Systems, because they installed the sign, they are the authorized distributor for Daktronics, and there performance of this work will not effect the warranty on the sign, and has recommended that this Council authorize dispensing with bidding requirements in accordance with subsection D.2. of Section 3.20.060 of the Bakersfield Municipal Code. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above-recitals are true and correct and incorporated herein by reference. 2. The Council hereby finds that raising the Daktronics electronic message center sign can only be reasonably obtained from one vendor, City Neon Sign Systems, because they are an authorized distributor, they constructed the original sign and they can maintain the warranty. 3. The sign has weathered and needs to be repainted at this time. 4. The Finance Director is authorized to dispense with bidding therefor and to negotiate the raising and painting of the sign, not to exceed $37,500.
