HomeMy WebLinkAboutRES NO 092-16RESOLUTION NO. 0 9 2 t 6 A RESOLUTION DISPENSING WITH BIDDING PROCEDURES DUE TO EMERGENCY REPAIRS OF THE MT. VERNON LCNG FUELING STATION LOCATED ON SOUTH MT. VERNON AVENUE, AND AUTHORIZING CLEAN ENERGY TO PERFORM NECESSARY REPAIRS, NOT TO EXCEED EIGHTY THOUSAND DOLLARS ($80,000). WHEREAS, on May 3, 2016, the Fleet Services Division was notified that the Mt. Vernon LCNG fueling station located on South Mt. Vernon Avenue was inoperable; and WHEREAS, Fleet Services sent staff members to the site to troubleshoot the fueling station, but were unable to determine the problem; and WHEREAS, Clean Energy was contacted that day to provide repairs to bring the fueling station back up to operation; and WHEREAS, over the course of the next days, Clean Energy worked on the fueling station in an effort to bring it back online; and WHEREAS, Clean Energy determined on May 19th, 2016 that the system had suffered a complete power failure and was down on fault, likely due to power surges resulting from lightning storms in the area; and WHEREAS, consequently, the Programmable Logic Controller (PLC), which is the digital computer that controls the entire station, is no longer communicating and Clean Energy recommends replacement due to overload damage; and WHEREAS, the Mt. Vernon LCNG fueling station currently fuels 63 LNG vehicles, 18 CNG vehicles, and nine contracted private refuse hauler's LNG vehicles; and WHEREAS, the City has two fueling sites, and it is critical that both remain operational to ensure vehicles are fueled efficiently and to prevent interruptions in service to the public if the second fueling site goes down at the same time; and WHEREAS, based on an invoice for work already completed and the quote provided for future work, Clean Energy estimates a total of $80,000 will be needed to complete the repair and bring the fueling station back up to operation, and this total exceeds the available balance on the current department service agreement with Clean Energy; and aFe PKF9 r -- Page 1 of 3 Pages -- m 0 .)g131 ^JAL WHEREAS, immediate repairs are necessary to ensure continued service to the public. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: The above recitals are true and correct and incorporated herein by reference. 2. Based on the facts included in the above recitals, the work already performed and future work needed from Clean Energy is of urgent necessity for the preservation of life, health or property, thereby allowing the dispensing of bidding requirements as set forth in Section 136 of the City Charter and Section 3.20.060 of the Bakersfield Municipal Code. 3. The Finance Director is authorized to dispense with bidding in accordance with Section 3.20.060 of the Bakersfield Municipal Code. 4. The expenditure of funds for emergency repairs described herein for the work, supplies, equipment and materials shall not exceed Eighty Thousand Dollars ($80,000).
