A RESOLUTION AUTHORIZING THE PUBLIC WORKS
DIRECTOR OR DESIGNEE TO EXECUTE PROGRAM
SUPPLEMENTAL AGREEMENTS WITH THE CALIFORNIA
DEPARTMENT OF TRANSPORTATION IN ORDER TO
RECEIVE FEDERAL FUNDING FOR TRANSPORTATION
PROJECTS.
RECITALS
WHEREAS, the City of Bakersfield ( "City ") is eligible to receive Federal funding
for certain transportation projects, through the California Department of
Transportation ( "CalTrans "); and
WHEREAS, Master Agreements and Program Supplemental Agreements need
to be executed by the City and the California Department of Transportation before
such funds can be claimed; and
WHEREAS, Master Agreements are general and contain all of the terms of
Federal funding and Program Supplemental Agreements are specific to each
individual project; and
WHEREAS, the last Master Agreement was executed in 2007 and CalTrans has
prepared a new agreement which the City must execute to be eligible to receive
transportation funding; and
WHEREAS, the City Council approves each project and allocated funding for
such project within the Capital Improvements Projects budget; and
WHEREAS, the City desires to expedite receipt of federal transportation funds
by authorizing the Public Works Director or designee alone to execute Program
Supplemental Agreements and any amendments to those particular agreements.
NOW, THEREFORE, BE IT RESOLVED, incorporating the above recitals herein, by
the Council of the City of Bakersfield as follows:
1. That the above recitals are true and correct.
2. All Master Agreements for federal funding must be approved by the City
Council.
3. The Master Agreement attached hereto as Exhibit "A" is hereby approved
and the Mayor or designee, the Public Works Director or designee, the City Attorney
or designee and the Finance Director or designee are authorized to execute it and
forward it to the Department of Transportation for execution.

4. The Public Works Director or designee alone are authorized to sign all
Program Supplemental Agreements with the California Department of
Transportation required to access federal transportation funding for specific
projects without further City Council action.
