John Ryan, Hydrographic Supervisor, reviewed the operations graphs and
stated the current Isabella storage is at 39,677 acre feet; inflow in the basin is
up due to the recent storm. The outflow is up and is expected to remain static
at 325 second feet, which is the power flow requirement for Edison Company.
Mr. Ryan reviewed the snow pack accumulation graph and stated last week
the State of California Department of Water Resources published the 13120
Forecast for the Kern River. The initial forecast was for 75% of normal at
350,000 acre feet, last Thursday they updated the forecast and dropped it to

A. 70% of normal or 330,000 acre feet. The forecast is expected to drop about
4% and the warm temperatures in the basin will play havoc. The current storm
is forecasted to bring in approximately six inches of snow. Information only,
no action taken.
B. Update on Water Usage in the City's Domestic Water Service Area for January
2016.
Jason Meadors, Water Resources Director, stated staff calculated the monthly
water reduction for January 2016 vs. January 2013. The City is at 11 %
reduction, which is well below the 36% needed to achieve the target set by
the state and disappointing. Mr. Meadors stated there has not been a lot of
house irrigation that occurred. The cumulative savings for our system is 27.9 %,
short of the 36% target. The state is looking at our savings through February 29,
2016 and our conservation goal is 36 %. Staff recently learned that the state is
going to adjust that goal to 321/o for the City of Bakersfield. One thing to note
is that 2015 and 2016 numbers are being compared to year 2013 numbers. In
this three year time period, total residential connections have increased by
2,600 and contributed to the decrease in our conservation reductions.
Information only, no action taken,
Art Chianello, Water Resources Manager, stated he agrees with Mr. Meadors
report. Since January approximately 70% of our water is used for outside
irrigation, about 30% is used for inside use. If everyone has their sprinklers
practically turned off for January it is harder to conserve and get the numbers
up. It is disappointing and we still need to be diligent and continue to get the
message out for conservation. Mr. Chianello stated we are still in a drought
and still under emergency regulations.
C. Report on State Water Resources Control Board's Extended Water
Conservation Regulation.
Art Chianello, Water Resources Manager, gave a brief update and stated the
current water conservation regulations that we are following by the State of
California were slated to expire the end of February 2016. On February 2, 2016
the State Water Resources Control Board adopted revised emergency
conservation regulations effective thru October 2016, In the revised
regulations it is important to note that the state made a few changes that
help out urban water suppliers. The two changes that help Bakersfield are an
adjustment for climate and an adjustment for population growth. Those
details are talked about more on the State's fact sheet. There are a few other
provisions that help water suppliers, but those adjustments do not apply to the
City. Another adjustment is recycled water for potable use. The City has
disinfected tertiary use water, but it is not quite potable water, Staff did write
letters to the state requesting a credit for non - potable tertiary treated water.
The City is not able to get a credit for that right now. All the urban water
purveyors would be in the same conservation target, but then the purveyors
would be able to get credits or deductions based on a few methodologies
that the state has adopted. For the City it would be climate adjustment
because Bakersfield is in a warmer, dryer climate, Our calculations show the

C. City would get a climate reduction of a -3 %. A second reduction available is
for population growth. Looking at our population growth and other factors,
the City is able to get another reduction of 1 %, That would give the City's
domestic service area an overall credit of 4 %, so now the new standard is
going to be 32% rather than 36 %.
Member Smith stated he read that the 32% was the maximum reduction; but
you say you could go up 8 %?
Art Chianello, Water Resources Manager, stated the early draft proposal was
a ceiling cap of 4 %. The City of Bakersfield and other agencies transmitted
comments to the State Water Resources Control Board and they revised the
adopted upper cap from 4% to 8 %.

Congressman regarding elimination of the salmon; and also stated that the Fish and
Game Commission will possibly hold a meeting here during this summer.
Chairman Hanson thanked Water Resources staff for stepping -up and doing an
outstanding job with a limited staff, due to recent retirements,

Agreement for Dry Year Water Supply between City and Kern County Water
Agency Improvement District No. 4 (not to exceed $400,000).
RECOMMENDATION: Staff recommends that the Water Board refer agreement to City Council
for approval.
BACKGROUND: On September 21, 2005, the City entered into a Water Supply Agreement with
Improvement District No. 4 (ID4) to receive 6,500 acre -feet of treated State Water Project (SWP)
water from the Henry C. Garnett Water Treatment Plant. Due to the ongoing drought
conditions, this 6,500 acre -feet of SWP surface water is not available this year.
Although surface water from the SWP is not available for City use again this year, there is
banked SWP water available to the City, which would require pumping to access. Because the
2005 agreement did not address banked SWP water and the associated pumping costs, the
City must enter into a separate agreement to get access to this water. The proposed
agreement includes a budgeted not to exceed cost of $100 per acre -foot for electrical costs to
operate pumps to recover the water stored in the ground. Under the proposed agreement, it is
estimated that approximately 3,000 acre -feet will be available as pumped SWP water (the
additional 1,000 acre -feet will recharge in the earthen lined canal), with the balance of the
necessary 6,500 acre -feet being supplied by extra pumping of City domestic water wells. Staff
is recommending that the term of the agreement run through December 31, 2016.
It should be noted the City is currently undertaking other options which will greatly reduce the
need to draw upon this critical dry year agreement. These options include the emergency well
head project recently approved by City Council which has the capacity to provide water to
the same area within the domestic water system. Another option is to use City Kern River water
and transport this water to ID4 treatment plant for a drinking water supply. Thus this Critical Dry
Year Supply Agreement is the third option in water planning and provides backup assurance.
Funds are available in the 2015/2016 fiscal year Water Resources operating budget. No General
Fund monies will be used. Staff is recommending approval of the agreement

AGREEMENT NO.
AGREEMENT FOR A DRY YEAR WATER SUPPLY BETWEEN
IMPROVEMENT DISTRICT NO.4 AND THE CITY OF BAKERSFIELD
This agreement entered this day of , 2016
between the Kern County Water Agency ("Agency "), individually and on behalf
of Improvement District No. 4 ( "ID4 "), and CITY OF BAKERSFIELD ("Customer ").
RECITALS
WHEREAS, the Agency has previously entered into long term water supply
agreements with the Customer dated September 21, 2005 ( "Water Supply
Agreement No. 05- 325 "), a model of which is attached hereto as Exhibit A;
WHEREAS, the Water Supply Agreement provides, pursuant to Article
12(A), that the Agency may use ID4 groundwater banking projects or in- district
wells for reducing shortages subject to a separate agreement between the
Agency and the Customer;
WHEREAS, ID4 staff has investigated the recovery capacity of the ID4
groundwater banking projects and in- district wells to provide dry year supplies to
reduce shortages to the Customer in years when treated water requests of the
Customer for New Entitlement cannot be met by ID4's surface water supplies;
WHEREAS,, ID4 staff has provided the Customer with analyses showing the
estimated costs of utilizing the recharge and recovery capacity of the ID4
groundwater banking projects and in- district wells to provide such dry year
supplies;
WHEREAS, the Customer desires to utilize the recovery capacity of the ID4
groundwater banking projects and in- district wells to receive a dry year water
supply from ID4 to reduce shortages as provided for in the Water Supply
Agreement.
NOW THEREFORE, for good and valuable consideration, the receipt and
sufficiency of which are hereby acknowledged, the Agency and Customer
agree as follows:
Incorporation of Water Supply Agreement.
The provisions of the Water Supply Agreement; including but not
limited to those that define the terms used in this agreement and
those that describe the obligation and method of payments, are
hereby incorporated by reference into this agreement.
2. Schedule for Dry Year Supplies.
(a) By March 1, 2015, the Agency provided the Customer with a
preliminary estimate of ID4's recovery capacity for dry year
supplies for the succeeding year.
(b) By April 1, 2016, the Customer will provide the Agency with its
preliminary dry year water supply request and delivery
schedule for that year.
(c) By May 1, 2016, the Customer will provide IN with its final dry
year water supply request and delivery schedule for that
year.
(d) After May 1, 2016, the Customer may propose to amend its
dry year water supply request and delivery schedule for that
year. The Agency shall review any proposed amendments
and provide an updated delivery schedule within two weeks
of the request.
(e) Agency shall endeavor to at all times keep the Customer
apprised of State Water Supply anticipated allocations so
that the Customer may make informed decisions about dry
year supply needs.
3. Costs and Payments for Dry Year Supplies.
(a) By March 1, 2015, the Agency provided the Customer with a
preliminary estimate and detailed breakdown of the costs for
dry year supplies, including any ID4 administrative costs, for
the succeeding year.
(b) By May 1, 2016, the Customer shall pay 25% of the dry year
water supply charges due to ID4 for that year that are
attributable to such Customer's preliminary dry year water
supply request and delivery schedule. The remaining 75% of

the dry year water supply charges due to ID4 for that year will
be collected in equal installments on a monthly basis in those
months for which the Customer has requested delivery of any
dry year water supplies.
(c) ID4 will reconcile all dry year water supply costs when final
costs for the recovery of such supplies are available and by
substituting actual deliveries for the requested deliveries
made pursuant to 2(c) and 2(d). The Customer will be
charged a melded rate for recovery over all ID4 groundwater
banking projects and in- district wells used to meet dry year
water supply requests.
(d) The Customer may, upon reasonable notice, reduce its dry
year water supply request and delivery schedule, and shall
not be obligated to make payments for dry year water
supplies that are not delivered to Customer pursuant to such
reduction.
4. Term of Agreement
This agreement shall terminate on December 31, 2016.
The parties hereto have caused this Agreement to be executed the day
specified below by the following duly authorized representatives of the
contracting parties.
