A. Kern River & Isabella Reservoir Operations Report
John Ryan, Hydrographic Supervisor, stated the graph remains the same; the
good news is the water year ends in September, so we can get off that
bottom flat line. Current operations at Isabella: midnight storage is at
30,901 acre feet; the inflow pre - project is 65 second feet per day, normally it
should be 314 on average, but averaging 65 cfs; the April -July run off estimate
is at 57,665 acre feet, that is still at 13 percent of normal, the worst on record.

B. Update on Water Usage in the City's Domestic Water Service Area for July
2015.
Jason Mead ors, Water Resources Director, provided the monthly usage for the
month of July. The total water produced, the domestic water service area
had a reduction of 31.5% over July 2013. Population growth was
approximately 7,000 people over the last two years, which equates to about
2,000 connections. There was a reduction in the residential per capita per
day of about 32% over the same time period. The City did not achieve the
36% target the state is requiring The state is tracking our cumulative savings
from June until February of next year. The cumulative savings for June was
33.9% and July 32.6%. Currently the cumulative savings is 32.6 %, under the
required 36%. Higher reductions will be needed through late summer and
early fall to meet the requirement. Mr. Meadors stated itis going to be very
difficult to achieve because of the cooling off period approaching. Staff
answered questions.
Chairman Hanson recognized Rudy Valles, Manager, California WaterService
Company. Mr. Valles stated Cal Water has met their required numbers but
has been struggling with the surcharge. Cal Water's reduction is 32% and they
are at 35.9% reduction. Mr. Valles stated Cal Water started conservation
efforts in 2006 and they have an advantage. He stated Cal Water's surcharge
process has not been as smooth as hoped and Cal Water is reviewing.
Member Maxwell asked if Cal Water is meeting the required reduction why is
Cal Watercharging a surcharge to itscustomers.
Mr. Valles stated the intent was to meet a budget that would be available in
the event the required reduction was not met. It was never the intent of Cal
Water to hurt anyoneand an appeal process is in place.
Art Chianello, Water Resources Manager, stated at the request of Chairman
Hanson, staff compared water usage for the months of June /July 2015 to
June /July 2013. Mr. Chianello stated the largest users were commercial and
industrial, large entities such as the City. He stated City parks had a 50 -56%
reduction; Cal State Bakersfield had a huge reduction of approximately 36 %;
Nestles Ice Cream also reduced their water usage substantially. It was good
to see because these were some of the users that when we first started talking
about the drought they called us and wanted to talk about how we can use
water more wisely and conserve and we saw that in the result for the most
part. We are not giving up hope t hat we cannot meet our 36% conservation
standard and are still looking at the top 50 water users to continue conserving.
The area that we can conserve the most is outside irrigation on residential
lawns. Our major water users are 73 -74% residential, for them to cut back a
little bit more would be a very large percentage swing in our favor as we go
into the fall. We still need to meet our conservation standards set by the state.
I would say that we would still encourage private residential water users to
continue to cutback and use water wisely.

A. Administrative Citations:
1. Emergency Ordinance Amending Chapter 14.02 to the Bakersfield
Municipal Code relating to Regulationsfor Urban Water Conservation
to Limit Irrigation of Turf and Landscapes.
City Attorney Virginia Gennaro gave a brief presentation and stated the
Governor declared a state of emergency in January 2015 requiring water
conservation reduction levels to 36 %. The Council passed an emergency
ordinance in April 2015 with the intention of having residents limit outside
irrigation. The target was not met in June or July. In light of the fact that the
City has missed that target level in the last two months, the City Manager, City
Attorney's Office and the Water Board are concerned that if the City does not
meet the state reduction target the City may be on schedule and on tract for
a cease and desist order from the State Water Control Board that will trigger
the $10,000 a day penalty. Staff has been exploring methods that can
emphasize to the community the importance of water conservation. City
Attorney Gennaro distributed a draft ordinance for review and gave dDrief
overview of the proposed ordinance authorizing an administrative process to
issue an administrativeticket. The City needs to meet the 36% reduction, and
the administrative process is more practical at this time than the criminal
process.
City Manager Alan Tandy stated the education process did not work. It is
fairer to cite the violators locally rather than to assess a state penalty and pass
it onto everyone whether they conserved or not. It does provide additional
remedies to demonstrate to the State Water Board we aretrying our best to
get to their number.
Staff answered questions.
Chairman Hanson stated the goal is not to fine people; it is to reduce
consumption and reach the water conservat ion goal.
Motion by Maxwellto approve the Emergency Ordinance and refer to the full
City Council for adoption. APPROVED ALL AYES,WITH SMITH ABSENT.
Independent Contractor 's Agreement with Carollo Engineers, Inc., ($90,000)
for On -call Services for Implementation of the 2014 Storm Water Management
Plan
Motion by Maxwell to approve the agreement with Carollo Engineers, Inc.
and refer to the full City Councii for final approval. APPROVED ALL AYES, WITH
SMITH ABSENT

SUBJECT: Kern River South Levee Accreditation by the U.S. Department of Homeland
Security Federal Emergency Management Agency (FEMA)
RECOMMENDATION: Item for Board Information only.
BACKGROUND: The Kern River Levee District was formed in 1928 with the single responsibility to
operate and maintain a levee system along the Kern River through Bakersfield. On March 28,
2000 the Local Agency Formation Commission approved the merger of the Kern River Levee
District with the City of Bakersfield and establishment of a Subsidiary District. The attached map
shows the location of the river levees. The purpose of the Kern River levee system is to hold
back and contain high river flows and prevent flooding of developed areas. The Flood Map
Modernization program, a multi -year Presidential initiative funded by Congress from 2003 to
2008 called for the nation's flood maps to be improved and updated.
On April 23, 2007, the U.S. Department of Homeland Security notified the City of Bakersfield and
the County of Kern that FEMA was in the process of the Flood Map Modernization Program. The
existing Kern River levees, at the time of this notification, were accredited by FEMA for the 100
year flood event. During the Map Modernization process, FEMA would continue to accredit the
levee as a Provisionally Accredited Levee system (PAL).
It was the City's responsibility to provide data and analysis to FEMA so that once approved,
FEMA can once again permanently accredit the Kern River South levee for providing protection
against the 100 year flood event.
Levee data, flood model analysis, and geotechnical reports were submitted to FEMA in July
2011. After several review cycles, the re- accreditation process for the levees is finally complete,
as described in the letter Dated September 3, 2015 from FEMA. According to the letter, the
Kern River South Levee now meets the minimum certification criteria outlined by the Code of
Federal Regulations. FEMA plans on continuing to accredit the levee system on the next Flood
Insurance Rate Map update as providing protection from the 100 year flood. The accreditation
will allow insurance companies to set reasonable rates and premiums for properties with the
area protected by the levee.

The above documentation and data have been reviewed, and based on receipt of'this
information, the Kern River South Levees (Kern County Levee IDs 8, 9, 10. 13, 14, 15.
18, 99, 100, 200, and 201), meet the minimum certification criteria outlined in 44 CFR
65.10. Therefore, we plan to continue to accredit this levee system on the next Flood
Insurance Rate Map (FIRM) update as providing protection from the 1- percent- annual-
chance (base) flood. The area protected from the base flood by this levee will be mapped
as a shaded Zone X, and a note will be placed warning of the flood risk that still exists.
Please be advised that levee systems, and the estimated level of protection provided by
these systems, can and do change with time. Future map updates may require the levee
system to be certified again at the time of update. Also, design, construction, operation,
and /or maintenance documents may be requested at any time. Deviations from the
documentation and data submitted to FEMA could result in the levee system no longer
being mapped as providing protection from the base flood on future FIRMS. If at any
point additional information is provided to FEMA that shows the levee system no longer
meets certification criteria as outlined in 44 C:FR 65. 10, we will contact the levee owner
and community about the possibility of de- accrediting the levee system.

Update on Water Usage in the City's Domestic Water Service Area for August and
September 2015.
RECOMMENDATION: For Board information.
BACKGROUND: The emergency drought regulations implemented by the Governor
require the City to report water usage to the State by the 15th of each month. The City
began reporting monthly water usage for its domestic water service area in June 2014.
Table 1 below shows information that was reported to the State for the months of
August and September 2015. Note that one (1) CCF is one hundred cubic feet, or 748
gallons. "R -GPCD" is the residential gallons per person per day water usage.

WATER BOARD
The State Water Resources Control Board will assess compliance for the period of June
1, 2015 through February 29, 2016. The City's conservation standard goal is 36 %, which
was established by the State. As of the end of September 2015, the City's cumulative
savings is 31.5% as shown in Table 2 below.
