A RESOLUTION DISPENSING WITH BIDDING
PROCEDURES DUE TO EMERGENCY SEWER
REPAIRS FOR THE SEWER LIFT STATION AT
HOSKING AVENUE AND AKERS ROAD, AND
AUTHORIZING THE PURCHASE OF THREE
"ABS /SULZER SUBMERSIBLE PUMPS" FROM
FLOW N CONTROL, INC (SOLE DISTRIBUTOR
OF "ABS /SULZER SUBMERSIBLE PUMPS" FOR
THE CITY'S GEOGRAPHICAL REGION), NOT
TO EXCEED $75,000
WHEREAS, Streets Division staff have responded daily to SCADA System
alarms at a sewer lift station located at the intersection of Hoskings Avenue and
Akers Road; and
WHEREAS, there are three pumps at this site which should operate in
rotation with one pumping operating at a time; and
WHEREAS, currently all three pumps are operating simultaneously which
can cause sewer overflows and is not energy efficient leading to higher
electricity costs; and
WHEREAS, pursuant to subsection DA of Section of 3.20.060 of the
Bakersfield Municipal Code, the Public Works deemed rehabilitation of this lift
station to be of urgent necessity for the preservation of life, health, or property
because of the potential for sewer overflows; and
WHEREAS, the lift station was constructed in 1992 and the pumps are
obsolete and cannot be replaced; and
WHEREAS, these three pumps must be replaced with pumps that meet
City design standards, are compatible with the lift station's design, and can be
delivered to the City within a reasonable time frame; and
WHEREAS, "ABS /Sulzer submersible pumps" meet all of the three
preceding caveats; and
WHEREAS, Flow N Control Inc. is the sole distributor of "ABS /Sulzer
submersible pumps" for the City's geographical area; and
WHEREAS, the Public Works Director recommends the Council find said

purchase of three "ABS /Sulzer submersible pumps" for the lift station at Hosking
Avenue and Akers Road can only be reasonably obtained from Flow N Control,
Inc. because Flow N Control Inc. is the sole distributor of "ABS /Sulzer submersible
pumps" for the City's geographical area, and recommends the Council
dispense with bidding, in accordance with subsection D.2 of Section 3.20.060 of
the Bakersfield Municipal Code.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and are incorporated
herein by reference.
2. Based on the facts included in the above recitals, the purchase of
three "ABS /Sulzer submersible pumps" was of urgent necessity for
the preservation of life, health or property, thereby allowing the
dispensing of bidding requirements as set forth in subsection 0.4 of
Section 3.20.060 of the Bakersfield Municipal Code.
3. Based on the facts included in the above recitals, the City Council
hereby finds that said purchase of three "ABS /Sulzer submersible
pumps" can only be reasonably obtained from Flow N Control Inc.
because Flow N Control Inc. is the sole distributor of "ABS /Sulzer
submersible pumps" for the City's geographical area, thereby
allowing the dispensing of bidding requirements as set forth in
subsection D,2 of Section 3.20.060 of the Bakersfield Municipal
Code.
4. The Finance Director is authorized to dispense with bidding In
accordance with Section 3.20.060 of the Bakersfield Municipal
Code.
5. The expenditure of funds to Flow N Control Inc. for purchase of
three pumps shall not exceed $75,000.
