HomeMy WebLinkAboutRES NO 142-16RESOLUTION NO. 14 2 - 16 A RESOLUTION DECLARING REAL PROPERTY SURPLUS TO THE NEEDS OF THE CITY AND AUTHORIZING THE FINANCE DIRECTOR TO NEGOTIATE ITS SALE AgrmtIV -)11 X- Ref.QetA Hoar WHEREAS, the City acquired a fee simple interest in property located north of the Kern River and east of Mohawk Street as part of the Westside Parkway Project; and, WHEREAS, the City has completed the construction of the Westside Parkway and determined that a portion of that property is now surplus to its needs; and WHEREAS, Bakersfield Municipal Code 3.20.125 authorizes the negotiated sale of City property deemed to be "surplus "; and WHEREAS, Tricor Energy, LLC, a California Limited Liability Company has requested to purchase the surplus property that it and its predecessors in interest have conducted mineral extraction operations pursuant to the Red Ribbon Ranch Lease since 1927; and WHEREAS, Tricor has agreed to pay the fair market value of the surplus property as determined by an independent appraisal; and WHEREAS, the Bakersfield Planning Department found the sale of this property to be consistent with the Metropolitan Bakersfield 2010 General Plan pursuant to Government Code Section 65402. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The foregoing findings and recitals are true, correct, and incorporated herein. 2.
