AN ORDINANCE AMENDING CHAPTER 9.44 OF THE
BAKERSFIELD MUNICIPAL CODE RELATING TO CURFEW
FOR MINORS.
BE IT ORDAINED by the Council of the City of Bakersfield as follows:
SECTION 1.
Chapter 9.44 of the Bakersfield Municipal Code is hereby amended to
read as follows:
Chapter 9.44 CURFEW FOR MINORS
9.44.010 Hours - Exceptions.
It is unlawful for any minor, defined herein as a person under the age of
eighteen, to loiter upon the streets of the city, in places of amusement or
entertainment, or in other public places within the city, between the hours of ten
p.m. and five a.m., unless:
A. The minor is accompanied by a parent, guardian or other adult having
control or charge of the minor; or
B. The minor has gone to a place of amusement or entertainment, other than
one at which liquor or tobacco is sold or served, prior to eight p.m., and
has held over or been continued beyond ten p.m.; or
C. The minor has left a place of amusement or entertainment, a place of
employment, or social call after ten p.m., and is thereafter returning
directly to his /her home or place of residence in a reasonable manner.
9.44.020 Responsibility of parent or guardian.
It is unlawful for any parent, guardian or any adult having control, custody
or charge of a minor to permit, allow or let the minor loiter upon the streets of
the city or in places of amusement or entertainment or in other public places in
said city between the hours of ten p.m. and five a.m., of any day, unless said
minor is lawfully upon said streets or public places or places of amusement as
permitted by Section 9.44.010.

SECTION 2.
This Ordinance shall be posted in accordance with the provisions of the
Bakersfield Municipal Code and shall become effective thirty (30) days from and
after the date of its passage.

by the Council of the City of Bakersfield at a regular meeting thereof held on
