HomeMy WebLinkAboutORD NO 3007ORDINANCE NO. 3007 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING TITLE SEVENTEEN OF THE BAKERSFIELD MUNICIPAL CODE BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED SOUTH OF HARRIS ROAD, EAST OF WIBLE ROAD TO FREEWAY 99. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of those certain properties in the City of Bakersfield located south of Harris Road, east of Wible Road to Freeway 99; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject properties from and R-1 (One Family Dwelling) Zone to an M-1 (Light Manufacturing) Zone and from an MH (Mobile Home) Zone to an M-1 (Light Manufacturing) Zone; and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed pro- ject; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearing for a change of zoning of said properties, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that the proposed zoning is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project, and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of certain properties in said City, the boundaries of which properties are shown on the map hereto attached and made a part hereof, as follows: FROM AN R-1 (ONE FAMILY DWELLING) ZONE TO AN M-1 (LIGHT MANUFACTURING), OR MORE RESTRICTIVE ZONE: That portion of the City of Bakersfield, County of Kern, State of California, more par- ticularly described as follows: The northwest quarter of the the southwest quarter of Section 24, Township 30 South, Range 27 East, M.D.B.&M., consisting of 40.133 acres more or less. FROM AN MH (MOBILE HOME) ZONE TO AN M-1 (LIGHT MANUFACTURING), OR MORE RESTRICTIVE ZONE: The northeast quarter of the southwest quarter of Section 24, Township 30 south, Range 27 east, M.D.B.&M., in the City of Bakersfield, County of Kern, State of California, as per the official plat thereof on file in the Office of the Surveyor General. Excepting therefrom that portion of said land lying easterly of the westerly line of that certain land conveyed to the State of California in deed recorded December 15, 1969 in Book 3220, Page 598 of official records. Also excepting therefrom an undivided 1/2 interest in and to all oil, gas, petroleum, and other hydrocarbon substances and minerals within or underlying said land, or that may be mined and removed therefrom as reserved in deed recorded March 26, 1953 in Book 2059, Page 113 of official records. Also except all oil, gas, minerals, and other hydrocarbon substances within or underlying said land, or that may be produced and saved therefrom, providing that the grantor, his successors and assigns shall not conduct drilling or other operations upon the surface of said land, but nothing herein contained shall be deemed to prevent the grantor, his successors and assigns from extracting or cap- turing said minerals by drilling on adjacent or neighboring lands and/or from conducting subsurface drilling operations under said lands at a depth or 500 feet below the surface of said land so as not to disturb the surface thereof or any improvements thereon, as reserved by Ross J. Wooten, a widower, in deed recorded January 2, 1980 in Book 5255, Page 947, or Official Records. .......... o0o ..........
