HomeMy WebLinkAboutORD NO 3006ORDINANCE NO. 3006 AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTIONS 2.08.010B, 3.04.060, 3.20.100D, 3.20.120A, 3.20.120B, 3.20.120C, 320.125, 3.20.125A, 3.24.020, 8.32.100A, 8.32.100B, 8.32.100C, 8.32.100D, REPEALING SECTIONS 2.08.010C, 3.04.070, AND 8.32.100E OF THE BAKERSFIELD MUNICIPAL CODE RELATIVE TO FINANCE DEPARTMENT OPERATIONS. AND BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Section 2.08.010B of the Bakersfield Municipal Code is hereby amended to read as follows: 2.08.010 Office created. B. Pursuant to Section 39 of the City Charter, the finance director is the auditor-controller and in accordance with said section shall perform the duties of the auditor and treasurer, in addition to those set forth in this Chapter. SECTION 2. Section 2.08.010C of the Bakersfield Municipal Code is hereby repealed. SECTION 3. Section 3.04.060 of the Bakersfield Municipal Code is hereby amended to read as follows: 3.04.060 Created-Purpose. There is created a special reserve fund to be known and designated as "insurance fund" for the purpose of repairing munic- ipally owned buildings and other properties of the City, which may become damaged as a result of fire, accident, act of God, or the negligence of any person, and which buildings or property were not fully covered or protected by a policy of insurance against the damage, and for the purpose of defraying the costs incidental to the operation of the insurance program. Section hereby repealed. Section SECTION 4. 3.04.070 of the Bakersfield Municipal Code is SECTfON 5. 3.20.100D of the Bakersfield Municipal Code is hereby amended to read as follows: 3.20.100 Open market procedure. D. Oral Bids. Oral bids shall be obtained from prospec- tive suppliers by the finance director when the amount involved is two thousand five hundred dollars or less, unless at the finance director's discretion written bids have been obtained or bidding has been dispensed with in accordance with Section 3.20.060 or the amount involved is less than $400 and the finance director has determined more than one bid to be impractical; or the purchase is to be made through the petty cash procedures. SECTION 6. Section 3.20.120A of the Bakersfield Municipal Code is hereby amended to read as follows: 3.20.120 Surplus supplies and equipment. A. Upon authorization of the city manager, the finance director shall obtain competitive and formal quotations for the sale of surplus stock, materials or equipment, when any one item or group of items offered for sale amounts to more than four hun- dred dollars in appraised resale value. B. When items offered for sale amount to more than four hundred dollars in appraised resale value, the finance director shall cause notice of sale to be published at least five days before the sale, in the official newspaper, giving a general description of the items to be sold, where bids are to be received, and the time and place of sale. The finance director shall, in addition, solicit sealed quotations from prospective buyers, by telephone or by sending them copies of newspaper noti- ces, or other methods designed to reach the greatest number of prospective buyers. -2- C. When any separate item or items of such surplus stock, material or equipment to be offered for sale amounts to four hundred dollars or less, the finance director may accept informal written bids or quotations for the sale of such item or items, without causing a notice of sale to be published in a newspaper. SECTION 7. Section 3.20.125 of the Bakersfield Municipal Code is hereby amended to read as follows: 3.20.125 Sale of surplus real property. When it is found by the city manager that the city owns real property which is no longer needed by the city (except for property held in public trust), he shall report the property description and any other pertinent information to the city coun- cil which may authorize the sale thereof by the finance director and the proceeds from any such sale shall be deposited in the city treasury. Such sale shall be conducted either by competitive bids or by negotiated sale in the following manner: A. Competitive Bids. The finance director shall obtain an appraisal on the real property to be sold, when such property exceeds four thousand dollars in value, and shall advertise for competitive and formal bids with a minimum bid of no less than ten percent below the appraised value. If the property is valued at less than four thousand dollars, then the finance director may accept informal bids. The highest bid shall be accepted for sale. A~ the time and place of such sale, oral bids may be considered by the finance director after giving proper notice of such fact, pro- vided such oral bids shall be at least five percent higher than the highest written bid received at the time of opening of bids. The finance director may, at his discretion, require cash or cashier's check in an amount equal to ten percent of the bid price to be deposited by the bidder at the time of making or submitting his bid. The person to whom any bid is awarded shall consummate -3- the day of the award of such bid, unless otherwise provided by the finance director. SECTION 8. Section 3.24.020 of the Bakersfield Municipal Code is hereby amended to read as follows: 3.24.020 Disposition of funds. The proceeds from fees charged under the provisions of this chapter shall be transferred by the chief of police, or his authorized deputy, to the office of the finance director for depo- sit to the general fund. SECTION 9. Section 8.32.100 of the Bakersfield Municipal Code is hereby amended to read as follows: 8.32.~00 Billing, collection and payment of charges--Refunds. A. The collection of the charges imposed under this chapter shall be under the direction, supervision and control of the finance director. B. Collection of charges imposed under this chapter upon single-family dwellings, duplexes, triplexes and fourplexes shall be submitted by the finance director to the Kern County auditor- controller and tax collector, and to such other county officers as may be required, for placement of such charges as assessments on the secured roll of the county and he shall request that the tax collector each year collect and enforce the assessments in the same manner as ad valorem property taxes. With respect to all other charges, the finance director may require billings to be paid quarterly in advance; provided that the first quarterly charges shall be prorated for the unexpired number of months or major part thereof in such quarter. sale and purchase within fifteen days from then, excluding the -4- C. The finance director may make refunds of advance pay- ments on the same pro rata basis if requested in writing in affi- davit form by the depositor within three months from the date of any termination of an account, otherwise no refund shall be made. Adjustments for any increase or decrease of service shall other- wise be made only on a quarterly basis. Notwithstanding any other provisions in this chapter, should adjacent complexes of multiple- family dwellings sharing the use of detachable bins be subject to a greater charge under Section 8.32.030B than previously imposed under Section 8.32.040, the owners thereof shall be entitled, upon application to the finance director, to a refund of the dif- ference. D. All bills for the charges imposed under this chapter are due and payable upon billing therefor and become delinquent sixty days after billings are mailed. An additional ten percent administrative service charge and interest at the rate of one per- cent per month shall be added to any surcharge which is delinquent. Should the city resort to court action to collect amounts due, the city shall be entitled also to collect its rea- sonable costs. SECTION 10. Section 8.32.100E of the Bakersfield Municipal Code is hereby repealed. SECTION ll.
