RELEASE AT BERNARD and SONS 4011 JEWETT AVENUE,
BAKERSFIELD, CALIFORNIA.
Dear Mr. Bernard,
Based on the review of the data in the subject case file, the
Bakersfield Fire Department CUPA with concurrence from Central
Valley Regional Water Quality Control Board has determined that
case closure ("no further action") appears appropriate for the above
mentioned site. The wells used for groundwater monitoring and
remediation at the site also appear to be destroyed in accordance
with the Kern County regulations.
Nothing in this determination shall constitute or be construed as a
satisfaction or release from liability for any conditions or claims arising
as a result of past, current, or future operations at this location.
Nothing in this determination is intended or shall be construed to limit
the rights of any parties with respect to claims arising out of or relating
to deposit or disposal at any other location of substances removed
from the site. Nothing in this determination is intended or shall be
construed to limit or preclude the Regional Water Quality Control
Board or any other agency from taking any further enforcement
actions.
This letter does not relieve the parties involved of any responsibilities
mandated under the California Health and Safety Code and
California Water Code if existing, additional, or previously unidentified
contamination at the site causes or threatens to cause pollution or
nuisance or is found to pose a threat to public health or water quality.
