HomeMy WebLinkAboutRES NO 009-17RESOLUTION NO. 0 D 9— 1 A RESOLUTION BY THE COUNCIL OF THE CITY OF BAKERSFIELD APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE CALIFORNIA URBAN RIVERS GRANT PROGRAM UNDER THE WATER QUALITY, SUPPLY, AND INFRASTRUCTURE IMPROVEMENT ACT OF 2014 (Proposition 1). WHEREAS, the Legislature and Governor of the State of California have provided Funds for the program shown above; and WHEREAS, the California Natural Resources Agency has been delegated the responsibility for the administration of this grant program, establishing necessary procedures; and WHEREAS, said procedures established by the California Natural Resources Agency require a resolution certifying the approval of applications) by the Applicants governing board before submission of said application(s) to the State; and WHEREAS, the City of Bakersfield, if selected, will enter into an agreement with the State of California to carry out the Project NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows, 1. Approves the fling of an application for the Median and Streetscape Improvement Project (Prop 1 Grant). 2. Certifies that the City of Bakersfield understands the assurances and certification in the application. 3. Certifies that the City of Bakersfield or title holder will have sufficient funds to operate and maintain the Project(s) consistent with the land tenure requirements; or will secure the resources to do so. 4. Certifies that it will comply with all provisions of Section 1771.5 of the California Labor Code. 5. If applicable, certifies that the project will comply with any laws and regulations including, but not limited to, the California Environmental Quality Act (CEQA), legal requirements for building codes, health and safety codes, disabled access laws, and, that prior to commencement of construction, all applicable permits will have been obtained. s. Certifies that applicant will work towards the State Planning Priorities intended to promote equity, strengthen the economy, protect the environment, and promote public health and safety as included in Government Code Section 65041.1. o40PKF9 sT m U O ORIGINAL 7. RECITALS WHEREAS, the purpose of the California Urban Rivers Grani is to fund projects that enhance mull- benefit watersheds and urban rivers within urban waters that increase regional and local water self - sufficiency: and WHEREAS, the Recreation and Parks Department can meet two of the five statutory conditions (uses soils, plants, and natural processes to treat runoff and increase regional and local resiliency and adaptability to climate change) and; WHEREAS, the Recreation and Parks and Public Works Department -have a proposed project that can be used to meet the statutory conditions; and WHEREAS, the State of California requires a resolution be submitted with the grant application to authorize City staff to submit o proposal for the grant; and WHEREAS, the City of Bakersfield, if selected, will enter into an agreementwith the California National Resources Agency to carry out the proposed project. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield as follows: 1. Approves the filing of an application to the California Natural Resources Agency to obtain o California Urban Rivers Grant pursuant to Proposition 1; The Water Quality, Supply, and Infrastructure Improvement Act of 2014. 2, Authorizes the City to enter into an agreement to receive a grant for converting asphalt medians and dirt shoulders into streetscapes with drought tolerant vegetation. ary 3.
