AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING TITLE SEVENTEEN OF THE
BAKERSFIELD MUNICIPAL CODE BY CHANGING THE LAND
USE ZONING OF THOSE CERTAIN PROPERTIES IN THE
CITY OF BAKERSFIELD LOCATED IN THE VICINITY OF
THE INTERSECTION OF PANORAMA DRIVE EXTENSION
AND MORNING DRIVE EXTENSION.
WHEREAS, in accordance with the procedure set forth in
the provisions of Title 17 of the Municipal Code of the city of
Bakersfield, the Planning Commission has held a public hearing on
a petition to change the land use zoning of those certain
properties in the City of Bakersfield located in the vicinity of
the intersection of Panorama Drive Extension and Morning Drive
Extension; and
WHEREAS, the Planning Commission, as a result of said
hearing, did make several general and specific findings of fact
which warranted a negative declaration of environmental impact
and a change of zoning of the subject properties from an R-1
to and R-3, and an R-1 to a c-l, and the Council has considered
said findings and all appear to be true and correct; and
WHEREAS, there appears to be no substantial detrimental
environmental impact which could result from the proposed pro-
ject; and
WHEREAS, the City Council has determined after due con-
sideration of said petition and the recommendations of the
Planning Commission herein on file, together with the reasons
advanced at the hearing for a change of zoning of said
properties, that a zoning change should be authorized; and
WHEREAS, the City Council has determined and found that
the proposed zoning is consistent with the General Plan of the
City of Bakersfield.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
1. All of the foregoing recitals are hereby found to be
true and correct.
2. An environmental assessment was made of the project,
and a Negative Declaration was adopted by the Planning Commission
after a public hearing thereon, and this Council hereby approves
and adopts the Negative Declaration.
3. Section 17.06.020 (Zoning Map)
of the City of Bakersfield be and the same
of the Municipal Code
is hereby amended by
changing the land use zoning of certain properties in said City,
the boundaries of which properties are shown on the map hereto
attached and made a part hereof, as follows:
FROM AN R-1 (ONE-FAMILY DWELLING) ZONE TO AN
R-3 (LIMITED MULTIPLE-FAMILY DWELLING), OR
MORE RESTRICTIVE ZONE. FOR T~REE PARCELS.
The northwest quarter of the southwest quarter
of the southeast quarter of Section 13,
Township 29 south, Range 28 east, M.D.B.&M.,
containing 10.17 acres.
Also:
Beginning at the east quarter corner of said
Section 13, Township 29 south, Range 28 east;
Thence south 0°10'05" west along the east line
of said Section 13, 385.01 feet;
Thence south 89°39'43" west, 350.01 feet;
Thence north 0°10'05" east, 715.01 feet;
Thence north 89°39'43" east, 349.58 feet to a
point on said east line of Section 13;
Thence south 0°05'37" west along said east
line, 330.00 feet to the east quarter corner
of said Section 13 and the True Point of
Beginning, containing 5.74 acres.
Also:
Beginning at the southeast corner of the
northeast quarter of the southeast quarter of
Section 13, Township 29 south, Range 28 east,
M.D.B.&M.
Thence south 89°37'07" west along the south
line of said northeast quarter of the south-
east quarter, 600.00 feet;
Thence north 24°47'47" east, 559.84 feet to a
point on the centerline of the proposed
Panorama Drive extension;
Thence south 89°54'39" east along said cen-
terline, 350.00 feet to a point on the east
line of said Section 13;
Thence south 0°10'05" west along said east
line, 540.00 feet to said southeast corner of
the northeast quarter of the southeast quarter
of said Section 13 and the Point of Beginning,
containing 5.91 acres.
FROM AN R-1 (ONE-FAMILY DWELLING) ZONE TO A
C-1 (LIMITED COMMERCIAL) ZONE, OR MORE
RESTRICTIVE ZONE:
Commencing at the east quarter corner of
Section 13, Township 29 south, Range 28 east,
M.D.B.&M.;
Thence south 0°10'05" west
of said Section 13, 385.01
Point of Beginning;
along the east line
feet to the True
Thence, continuing south 0°10'05" west along
said east line 404.46 feet to a point of
intersection of the proposed alignments of
Morning Drive and Panorama Drive;
Thence north 89°54'39" west along the proposed
centerline alignment of Panorama Drive, 350.00
feet;
Thence north 0°10'05" east 401.85 feet;
Thence north 89°39'43" east, 350.01 feet to a
point on the east line of said Section 13 and
the True Point of Beginning, containing 3.24
acres.
EXCEPTING THEREFROM those areas within the
rights-of-way of proposed Panorama Drive
extension and Morning Drive extension.
subject to the following amendments to the application accepted
by the applicant:
The applicant shall meet all conditions as
result from subsequent site plan review
for the project.
The R-1 low density area shall not exceed
an average of four dwelling units per gross
acre. The total number of dwelling units
will not exceed 1,093 units which is
permitted under the present general plan
designations.

All on- and off-site improvements as
required by City to meet residential and
commercial development standards are to
be installed by the developer.
This ordinance shall be posted in accordance with the
City charter provisions and shall become effective thirty (30)
days from and after the date of its passage.

I HEREBY CERTIFY that the foregoing Ordinance was passed
and adopted by the Council of the City of Bakersfield at a regu-
