QQC SPREADING SERVICES ON FREEWAY EMBANKMENTS CANNOT BE OBTAINED THROUGH THE USUAL BIDDING PROCEDURES BECAUSE OF THE LACK OF LOCAL CONTRACTORS ABLE TO HANDLE THE TYPE OF MATERIAL AVAILABLE AND AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH BIDDING THEREFORE, NOT TO EXCEED $250,000 FOR FY 2016/17 WHEREAS, the City of Bakersfield has an excess supply of recycled wood chip material due to the 2015 closure of the local biomass power plant in Delano, CA; and WHEREAS, the City is striving to locate and use alternate outlets for said surplus material; and WHEREAS, the landscape areas of the West Side Parkway (WSP) are a usable outlet for said material; and WHEREAS, the City has arranged for delivery of said material to the WSP via contracting with a trucking company; and WHEREAS, after delivery of said material to the WSP a contractor with certain equipment suitable for freeway embankment application of wood chip material is necessary to apply said material to the landscape; and WHEREAS, J &M Land Restoration, Inc. (J &M) is the only local contactor equipped suitably to handle said project; and WHEREAS, the City previously contracted with J &M to do similar work under Agreement PW 17 -021; and WHEREAS, the City and J &M mutually desire to amend said Agreement to complete the project as identified by the City; and WHEREAS, the Public Works Director recommends the Council find said work can only be reasonably obtained from J &M, and because of the need for expediency to utilize excess wood chips to relieve congestion and fire danger at the City's wood chip production facility, recommends the Council dispense with bidding, in accordance with subsection D.2 of Section 3.20.060 of the Bakersfield Municipal Code. The City Council hereby finds that the spreading of wood chip material on freeway embankments on the West Side Parkway can only be reasonably obtained from one contractor (J &M Land Restoration, Inca because of the necessity to utilize excess wood chips in an expeditious manner. 3. The finance Director is authorized to dispense with bidding and to negotiate the purchase of same, not to exceed $250,000.
