ORDINANCE AMENDING CHAPTER 8.16 OF THE
BAKERSFIELD MUNICIPAL CODE RELATING TO ICE CREAM
TRUCKS.
BE IT ORDAINED by the Council of the City of Bakersfield as follows:
SECTION 1.
Chapter 8.16 of the Bakersfield Municipal Code is hereby amended to
read as follows:
Chapter 8.16 ICE CREAM TRUCKS
8.16.010 Ice cream truck defined.
"Ice cream truck" includes any vehicle defined in the California Vehicle
Code from which ice cream, ice milk, frozen dairy products, and /or flavored ice
)herein collectively referred as frozen treats) are the only items offered for retail
sales on city streets.
8.16.020 General Requirements.
A person operating an ice cream truck must:
1. Maintain a valid business tax certificate from the City of Bakersfield;
2. Maintain a valid permit from the County of Kern through its Public
Health Services Department;
3. Clean up all trash and litter generated within a minimum fifty -foot
radius of the ice cream truck.
8.16.030 Vehicle condition and maintenance.
Ice cream trucks must meet the vehicle condition and maintenance
guidelines outlined in the California Health and Safety Code.
8.16.040 Frozen treats.
All frozen treats shall comply with the rules, regulations and requirements
of the Kern County Public Health Services Department.

8.16.050 Selling— Distance from public buildings, parks and playgrounds.
Ice cream trucks must park at least 300 feet from the exterior boundary of
a property used and occupied by any school, public playground or park
maintained and operated by the city, or other public corporation.
8.16.060 Selling — Amplified sound requirements.
A. An ice cream truck may only use amplified music or speech
emitted via sound equipment during the following hours:
Nine a.m. to five p.m. on Sundays; and
2. Eight a.m. to eight- thirty p.m. from May 1st through September,
Monday through Saturday; and
3. Nine a.m. to five p.m. from October 1st through April on Mondays
through Saturdays.
B. The volume of sound from any vehicle referenced in subsection A of
this section shall be controlled so that it will not be audible for a distance in
excess of one hundred fifty feet from the vehicle upon which such sound
equipment is located, and so that such volume is not unreasonably loud,
raucous, jarring, disturbing or a nuisance.
SECTION 2.
This Ordinance shall be posted in accordance with the provisions of the
Bakersfield Municipal Code and shall become effective thirty (30) days from and
after the date of its passage.
