A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD EXTENDING THE TERM OF A PLANNING
COMMISSIONER
WHEREAS, the Planning Commission is a seven- member board that
performs duties and exercises power and authority with regard to planning,
zoning, and land use regulatory controls per ordinance and state law; and
WHEREAS, pursuant to Bakersfield Municipal Code section 2.28.030, each
councilmember has a nomination /appointment to the Planning Commission;
and
WHEREAS, Richard Schwartz is the Ward 5 representative on the Planning
Commission and his term expires on April 30, 2017; and
WHEREAS, the councilmember for Ward 5 has the right to nominate the
next Planning Commissioner but since the Ward 5 councilmember seat is
currently vacant until June 2017; and
WHEREAS, the City Council desires to extend the term of Mr. Schwartz until
the newly elected Ward 5 councilmember has an opportunity to nominate a
planning commissioner; and
WHEREAS, there are no term limits for Planning Commissioners and Mr.
Schwartz is agreeable to continuing his service in light of the situation.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Bakersfield as follows:
1. The above recitals are true and correct and incorporated herein.
2. The City Council hereby extends the term of Planning Commissioner
Richard Schwartz until the newly elected Ward 5 councilmember
appoints a planning commissioner or December 31, 2017,
whichever occurs first.
HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on
MAR 2 9 2017 by the following vote:
