HomeMy WebLinkAboutRES NO 042-17RESOLUTION NO. 042- 1 7 A RESOLUTION DECLARING THE SPEAKEASY HOUSE AND REAL PROPERTY SURPLUS TO THE NEEDS OF THE CITY AND AUTHORIZING THE FINANCE DIRECTOR TO NEGOTIATE THEIR SALE WHEREAS, the City acquired a fee simple interest in property located at 2401 Bay Street and 2312 241h Street for the 24th Street Widening Project ( "Project "); and, WHEREAS, 2312 24th Street is the current location of what has commonly been referred to as the "speakeasy" house (the "Structure "); and, WHEREAS, a portion of 2401 Bay Street will be used for the Project; the unused portion will be combined with other unused real property into a new legal lot designated as 2405 Bay Street (the "Real Property "); and, WHEREAS, the Structure and the Real Property are not needed for the Project ( "Surplus Property "); and, WHEREAS, the City desires that the Structure be relocated onto the Real Property, to preserve The Structure in the area north of 24th Street; and, WHEREAS, the City desires to sell the Real Property and the Structure in order to clear the right -of -way for the 24th Street Widening Project; and, WHEREAS, the sale of the Real Property and the Structure to Buyer is contingent on Buyer's agreement to relocate the Structure from its current location on 2312 24th Street to the Real Property within the time frames required by City; and, WHEREAS, Bakersfield Municipal Code 3.20.125 authorizes the negotiated sale of City -owned real property deemed to be "surplus "; and, WHEREAS, Staff has proposed negotiating the sale of the Structure and Real Property through an auction process; and, WHEREAS, the Bakersfield Planning Department found the sale of the Real Property to be consistent with the Metropolitan Bakersfield 2010 General Plan pursuant to Government Code Section 65402. Speakeasy resolufion.aoc 3/23/2017 DMA Page 1 of 3 o�0ANF9`t -n m v o ORIGINAL NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: The foregoing findings and recitals are true, correct, and incorporated herein. 2. The Structure and the Real Property depicted in Exhibit 'A," attached hereto, is hereby declared surplus to the City's needs and the Finance Director is authorized to negotiate their sale. 3. City staff may to take all necessary steps to complete the sale and relocation of the Structure to the Real Property, and the Public Works Director may execute all related documents on behalf of the City.
