AN ORDINANCE OF THE BAKERSFIELD CITY COUNCIL APPROVING
AN AMENDMENT TO TITLE 17 OF THE BAKERSFIELD MUNICIPAL
CODE TO CHANGE THE ZONE DISTRICT LOCATED NORTH OF
SNOW ROAD, EAST OF QUAIL CREEK ROAD; AND SOUTH OF
ETCHART ROAD, WEST OF COFFEE ROAD. (ZC NO. 16- 0463).
WHEREAS, McIntosh & Associates, Inc., for Kern Land Partners, LLC and Bidart Dairy II, LLC, filed
an application with the City of Bakersfield Community Development Department requesting to
change the zone district from E (Estate One - Family Dwelling) to R -1 (One - Family Dwelling) on
38,251 gross sq.ft., located north of Snow Road, east of Quail Creek Road; from R -2 /PUD (Limited
Multiple- family Dwelling /Planned Unit Development) to R -1 (One - Family Dwelling) on 22,693 net
sq.ft.; and R -1 (One - Family Dwelling) to R -2/PUD (Limited Multiple - family Dwelling /Planned Unit
Development) on 40,192 net sq.ft., located south of Etchart Road, west of Coffee Road. (the
"Project "); and
WHEREAS, the Planning Commission held a public hearing on February 2, 2017, and approved
Resolution No. 04-17, which recommended that the City Council approve the Project; and
WHEREAS, initial studies were conducted for the original projects (General Plan
Amendment /Zone Change No. 05 -0931 and General Plan Amendment /Zone Change No. 05-
1932) which encompass the subject property and it was determined that the Project would not
have a significant effect on the environment, and Negative Declarations with mitigation
measures were approved by the City Council on March 8, 2006, in conjunction General Plan
Amendment /Zone Change No. 05 -0931, and on September 13, 2006 in conjunction General Plan
Amendment /Zone Change No. 05 -1932, in accordance with California Environmental Quality
Act (CEQA); and
WHEREAS, the City Council considered all facts, testimony, and evidence concerning the
Project, including the staff report and the Planning Commission's deliberation, and action; and
WHEREAS, the Project is consistent with the Metropolitan Bakersfield General Plan.
SECTION 1.
NOW, THEREFORE, BE IT ORDAINED by the Bakersfield City Council as follows:
1. The above recitals, incorporated herein, are true and correct.
2. The Planning Commission's findings as contained in its Resolution No. 04 -17 are hereby
adopted.
3. Said Negative Declarations for the Project is the appropriate environmental documents to
accompany approval of the Project. In accordance with State CEQA Guidelines Section
15162, no further environmental documentation is necessary because no substantial
changes to the original project are proposed, there are no substantial changes in
circumstances under which the project will be undertaken, and no new environmental
impacts have been identified. The Project will not significantly impact the physical
environment because mitigation measures relating to air quality, traffic, and cultural
resources have been incorporated into the Project. oFeAK499

4. The Project is hereby approved incorporating the change into the official zoning map as
described in Bakersfield Municipal Code Section 17.06.020 located on the map as shown
in Exhibit A and as specifically described in Exhibit B, all of which are incorporated herein.
SECTION 2.
This ordinance must be posted in accordance with the Bakersfield Municipal Code and
will become effective not less than 30 days from and after the date of its passage.
