3021 NEW SERIES
AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTIONS 15.48.020 B.,
15.48.030 B., AND 17.08.180 OF THE BAKERSFIELD
MUNICIPAL CODE REGARDING PROTECTIVE ENCLOSURES
FOR CANALS AND DITCHES.

IT ORDAINED by the Council of the city of Bakersfield
SECTION 1.
Section 15.48.020 B. of the Bakersfield Municipal Code
is hereby amended to read as follows:
15.48.020 Protective enclosures for canals and ditches.
B. The fence, wall or other structure must be not less
than four feet in height with no openings large enough to admit a
child except through doors or gates as provided in Section
15.48.030. From and after September 1, 1983, any such fence
which is newly constructed or reconstructed shall be not less
than six feet in height.
SECTION 2.
Section 15.48.030 B. of the Bakersfield Municipal Code
is hereby amended to read as follows:
15.48.030 Doors or gates.
B. In lieu of such self-closing and self-latching
devices, the doors and gates on fences, walls or other structures
surrounding swimming pools, spas, canals or ditches may be
equipped with locks which shall be kept locked at all times when
the swimming pools, spas, or hot tubs are not in actual use or
when authorized personnel of the owner of the canal or ditch are
not present.
SECTION 3.
Section 17.08.180 of the Bakersfield Municipal Code is
hereby amended by adding thereto subsection G. to read as
follows:
17.08.180 Fences, walls and ledges.
G. Fences constructed prior to September 1, 1983,
intended to act as protective enclosures and to make canals
inaccessible to small children, are exempted from the
restrictions of subsections D., E. and F. of this section.
SECTION 4.
This ordinance shall be posted in accordance with the
city charter provisions and shall become effective thirty (30)
days from and after the date of its passage.

I HEREBY CERTIFY that the foregoing ordinance was passed
and adopted by the Council of the City of Bakersfield at a regu-
lar meeting thereof held on the 2nil day of April , 1986, by
