HomeMy WebLinkAboutRES NO 062-17062 -17 RESOLUTION NO A RESOLUTION OF THE BAKERSFIELD CITY COUNCIL TO UPHOLD THE APPEAL AND DENY CONDITIONAL USE PERMIT/ZONING MODIFICATION NO. 17 -0062 TO ALLOW AN B- PERSON ROOMING - HOUSE, AND 2 AUTOMOBILE PARKING SPACES WHERE A MINIMUM 4 SPACES ARE REQUIRED IN A R -1 (ONE - FAMILY DWELLING ZONE) DISTRICT LOCATED AT 6106 MARTINIQUE COURT (WARD 6). WHEREAS, Pinky Linithicumn, filed an application with the City of Bakersfield Community Development Department for: (1) Conditional Use Permit to allow an 8- person rooming -house in an existing residence (17.64.020.8); and (2) Zoning Modification to allow 2 automobile parking spaces where a minimum 4 spaces are required for the rooming -house (17.58.110.E.17) in a R -1 (One - Family Dwelling Zone) district located at 6106 Martinique Court (the "Project "); and WHEREAS, the Board of Zoning Adjustment on April 11, 2017, approved: (1) a conditional use permit to allow a 6- person rooming -house to expire on October 12, 2017; and (2) a zoning modification to allow two automobile parking spaces where a minimum of four spaces are required for the rooming- house, and the decision was appealed by the Gustavo Varela on April 21, 2017; and WHEREAS, the Clerk of the City Council set Wednesday, May 24, 2017, at 5:15 p.m. in the Council Chambers of City Hall, 1501 Truxtun Avenue, Bakersfield, California, as the time and place for a public hearing before the City Council to consider the appeal as required by Government Code Section 65355, and notice of the public hearing was given in the manner provided in Title 17 of the Bakersfield Municipal Code; and WHEREAS, during the hearing, the City Council considered all facts, testimony, and evidence concerning the staff report, and the Board of Zoning Adjustment's deliberation and action. NOW, THEREFORE, BE IT RESOLVED by the Bakersfield City Council as follows: 1. The proposed use is not essential and desirable to the public convenience and welfare. 2. The proposed use is not in harmony with the various elements and objectives of the Metropolitan Bakersfield General Plan. 3. The granting of the modification is not necessary to permit an appropriate improvement on the subject property. 4.
