A RESOLUTION DETERMINING THAT CERTAIN
PETERSON PACIFIC CORPORATION EQUIPMENT
PARTS AND SERVICES CANNOT BE REASONABLY
OBTAINED THROUGH THE USUAL BIDDING
PROCEDURES AND AUTHORIZING THE FINANCE
DIRECTOR TO DISPENSE WITH BIDDING THEREOF
AND PURCHASE SAID EQUIPMENT PARTS AND
SERVICES FROM PETERSON PACIFIC
CORPORATION, NOT TO EXCEED $120,000 OVER A
THREE -YEAR TERM.
WHEREAS, City currently has a Peterson Pacific Corporation electric tub grinder in
service at the CITY's Mt. Vernon Recycling and Composting Facility; and
WHEREAS, CITY is in need of new and replacement Peterson Pacific Corporation
equipment parts, in addition to the rendering of services; and
WHEREAS, Peterson Pacific Corporation equipment parts and services can only be
acquired through the manufacturer, Peterson Pacific Corporation; and
WHEREAS, it is necessary to purchase Peterson Pacific Corporation equipment
parts and services because of the critical function the grinder performs for the
processing of green waste material at the CITY's Mt. Vernon Recycling and Composting
Facility;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals are true and correct and incorporated herein by
reference.
2. As the sole distributor and service provider, the work and equipment
can only be reasonably obtained from one vendor, Peterson Pacific Corporation,
because of the need to successfully inspect, repair and maintain such equipment
that are already in operation within the City system.
3. The Finance Director is authorized to dispense with bidding in
accordance with Section 3.20.060 of the Bakersfield Municipal Code.
4. The expenditure of funds for said work and equipment shall not exceed
One Hundred Twenty Thousand Dollars ($120,000) over a three -year term.
