HomeMy WebLinkAboutRES NO 075-17RESOLUTION NO. 075- 1 7 RESOLUTION ADOPTING INCREASES TO FISCAL YEAR 2017/2018 AND 2018/2019 SEWER SURCHARGE FEES FOR COMMERCIAL USERS WHEREAS, Chapter 14.12 of the Bakersfield Municipal Code authorizes the City Council of the City of Bakersfield (City) to establish fees and charges to recover costs for services rendered; and WHEREAS, City staff prepared and mailed a notice of public hearing to commercial users as required by Proposition 218 notifying them of the proposed rate increases; and WHEREAS, a public hearing before the City Council was advertised twice in the Bakersfield Californian, a newspaper of general circulation; and WHEREAS, a public hearing was held in order to receive evidence and hearing all persons interested in or objecting to the proposed rate increases; and WHEREAS, the adoption of sewer fees is exempt from the California Environmental Quality Act (CEQA) under the California Public Resources Code Section 21080(b)(8); and WHEREAS, the adoption of sewer surcharge fees complies with Proposition 26 and Proposition 218; and WHEREAS, the City Council has considered information presented at the public hearing, the public comments, and written protests, and WHEREAS, the City Council adopted a five year plan outlined in the Wastewater Revenue Program Updated on June 4, 2014; and WHEREAS, Exhibit "A" summarizes commercial sewer surcharge fees proposed for Fiscal Year 2017/2018 and Fiscal Year 2018/2019. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals and findings are true and correct and are incorporated herein by reference. 2. The Council adopts fees established in Exhibit "A ". 3.
