Applicant further agrees that upon the expiration of the permit for which this application is made, if granted, or upon revocation thereof by the City Engineer, applicant will at his own cost and expense remove the same from the public property or right of way where the same is located, and restore said public property or right of way to the condition as nearly as that in which it was before the placing, erection, maintenance or existence of said encroachment. Applicant must contact Dig -Alert at 811 at least 2 full working days prior to all excavating. Applicant further agrees to obtain and keep all liability insurance required by the City Engineer in full force and effect for however long the encroachment remains. Please see email below. It sounds like Public Works is agreeable to keeping the six foot height for 104 Acapulco and possibly for 105 Acapulco if you can show that the wall won't impair your vision of pedestrians on the sidewalk while exiting your driveway. I would suggest that you contact Public Works and arrange a meeting with Mr. Wright to reach a resolution. You can reach him at 326 -3575. 1 know an encroachment permit has been issued for 104 and it may need to be modified to allow the six foot height. A separate permit will be needed for 105. If you have any other questions or need any more assistance, you can call or email me at your convenience. We will need to see plans on how the wall was constructed to make sure there is not a sight line issue with the driveway at 105 Acapulco. Also, if the new walls do have gates, then the permit will say that these accesses are for pedestrians only. If they want vehicle access at these locations, then driveways will need to be constructed with sidewalk behind the driveway to meet ADA requirements, and the gates /driveways will need to meet sight line requirements (in other words, there will be quite a bit of construction and probably re- construction required for vehicle access).
