Notable Items
On June 29, 2017, the California Supreme Court decided Jacks v. City of Santa
Barbara. The City has been watching this case carefully because it deals with the
validity of surcharge fees associated with franchise renewals and Prop. 218.
In Jacks, the City of Santa Barbara and Southern California Gas (SCE) renegotiated
its franchise fee from 1% to 2%, which included a 1% surcharge that was approved
by the Public Utilities Commission (PUC). The surcharge was legally challenged by an
individual and a hotel on the grounds the surcharge was invalid under Proposition
218 as a tax without voter approval.
The Supreme Court held that a charge imposed in exchange for franchise rights is a
valid fee rather than a tax only if the amount of the charge is reasonably related to
the value of the franchise. The Court further ruled that nothing in Proposition 218
limited the authority of a government to sell or lease its property or to limit the use of
the proceeds of such fees. However, since the parties and the lower courts in Jacksdid not apply the new reasonable value test for franchise fees, the Supreme Court
remanded the case back down to the lower court for trial. We will continue tomonitor the case, and will keep you posted.
Attached you will find the monthly Thomas Roads Improvement Program (TRIP)
Status Report for the month of July. The report gives a summary of each TRIP projectin construction, in design, and under review. Completion percentages and pictures
of projects are also included.
The City held yet another successful July 4th Community Celebration for the residentsof Bakersfield thanks to the very generous donations from our sponsors: PG&E,
Adventist Health, Rabobank NA, California Water Co., and E&B Natural Resources.The event, located at The Park at Riverwalk and Spectrum Amphitheatre, had an

estimated attendance of 20,000 people at its peak. The festivities included live music, great food from local vendors, and a spectacular fireworks display.

TRIP projects are moving rapidly through the various stages of project development. This
report is to provide a periodic up-to-date snapshot of each project’s recent major
activities and progress. If you have questions, or need additional information, please

MILESTONES
The TRIP team broke ground on the first phase of the Centennial Corridor Project on June 14th. The $41
million construction package for the Kern River Bridge Improvements Project includes the construction
of two new bridges, widens two existing bridges, and makes various improvements to the existing
Westside Parkway. The contractor will be moving dirt to the construction site in upcoming weeks, but
work on the river bridges will not begin until late summer due to high water levels in the Kern River.
The last full parcel needed for the 24th Street Improvement Project has been acquired. Bids for the
demolition of this house were opened on July 6th, and a contract is expected to be placed on the July
19th City Council agenda for consideration. Demolition work is currently underway for City-owned
properties on the south side of 24th Street.
Nearly 1.5 miles of protective privacy fencing was installed at various locations along the Centennial
Corridor alignment in June. The 8-foot high fences provide added privacy and will help shield residents
from future construction activities. Additional fencing will be installed as remaining structures are
demolished. The privacy fencing will remain in place until ultimate project improvements, such as new
fencing or sound walls, are in place.
The City of Bakersfield has advertised for Responsibility Statement and Questionnaires (RSQs) from
contractors interested in the Sanitary Sewer Relocation for the Centennial Corridor Project. This project
includes abandonment of existing sewer mains, manholes, and laterals that will conflict with the future
Centennial Corridor Project in Westpark and for the installation of new sewer mains, manholes, and
laterals as needed to complete the sewer system based on the new configuration. A temporary bypass
will be required to maintain sewer services during this work.
RSQs are due by 4 p.m. on Wednesday, July 26, 2017. The City plans to advertise for construction bids
on July 20, 2017. The City will only receive construction bids from general contractors who have been
approved to be on the Final Bidders List.

PROJECTS UNDER CONSTRUCTION
Beltway Operational Improvements
Contractor: Security Paving Company
67% complete; anticipated completion: spring 2018
This project includes various improvements along State Route 58, from State Route 99 to Cottonwood Road,
and on State Route 99, from north of Ming Avenue to Wilson Road.
Shoring has been removed and the contractor has finished backfilling the retaining walls at the Ming Pump
Plant on northbound State Route 99. Electrical and mechanical work will continue through July. The contractor
will also be working on the pavement structural section and drainage at this location.
Crews are installing deck steel for the new State Route 99 to eastbound State Route 58 Connector Bridge in
advance of placing concrete for the bridge deck. The deck pour may be scheduled in July.
Concrete was placed last month for the stems and soffit (girders and bottom of bridge) to widen the
westbound bridge at P Street. Concrete is expected to be placed for the eastbound stems and soffit at the P
Street Bridge in July.
A 125-foot long pre-cast girder was set in place at Madison Street in June, and ironworkers are now setting
steel at this location in advance of the closure pour.
Paving work was underway at the eastbound off-ramp at Cottonwood Road in June. Crews will also be
working on the southbound State Route 99 on-ramp at Ming Avenue.
Construction of retaining walls and sound walls continues along State Route 58. The installation of barrier rails
at Chester Avenue, H Street, and Union Avenue on- and off-ramps is also underway. Crews are working both day
and night shifts. Motorists should anticipate the potential of nighttime lane closures from Sunday through
Thursday nights between the hours of 9 p.m. and 5 a.m., between Union Avenue and Cottonwood Road.
Kern River Bridge Improvements
Contractor: Security Paving Company
0% complete; anticipated completion: summer 2019
A groundbreaking ceremony was held on June 14th. The contractor has started importing dirt to a site south
of Truxtun Avenue. Work to widen the river bridges across the river will not begin until water levels have
diminished.
PROJECTS IN DESIGN AND RIGHT-OF-WAY
24th Street Improvement Project
Designer: TYLin International
Design 95% complete; Right-of-Way 100% complete for full acquisitions
The City and Caltrans are reviewing the 95% roadway plans
The City is working on agreements with property owners in advance of advertising the sound wall
construction package along the north side of 24th Street in late summer 2017
Right-of-way activities for partial acquisitions are progressing
Workshops are being scheduled with utility companies for various utility relocations
Landscape plans are moving forward
Construction fencing has been placed around the five houses that will be demolished on the south side of
24th Street. Asbestos and lead abatement work is underway. The demolition contractor is working with
Habitat for Humanity’s ReStore to salvage various architectural items from these properties.

The 95% Constructability Review Meeting took place on May 18, 2017. Comments were addressed during
the month of June.
A safety review meeting was held June 19th
The City is working with San Joaquin Valley Railroad on a Construction and Maintenance Agreement and
the California Public Utilities Commission permit application; a first draft has been submitted.
Truxtun/Oak Intersection Operational Improvements
Designer: Dokken Engineering
Design 100% complete; Right-of-Way 86% complete
Categorical Exemption technical studies for NEPA clearance have been sent to Caltrans for review
Permits from the California Department of Fish & Wildlife, Army Corps of Engineers, and California Regional
Water Quality Control Board are pending
Centennial Corridor
Designer: Parsons
Design: 95% complete
Staff is pursuing potential funding opportunities for the project phase that would replace the Belle Terrace
Bridge over State Route 99.
Caltrans has reviewed the La Mirada and Marella Way structures. Minimal comments were received and the
roadway sheets are being finalized
Sewer, local streets, and sound wall packages are planned for early construction.
• An RSQ has been issued for contractors interested in the Sanitary Sewer Relocation for the

• The 2-story commercial structure that included the old Levitz Furniture building on the northwest
corner of California Avenue and Easton Drive has been removed
