Fitch Assessor— Recorder Kern County Official Records Recorded at the request of Public DOC #: 0213047115 SPACE ABOVE THIS LINE FOR RECORDER'S USE SOFIR 4/05/2013 9:12 AM Stat Types: 1 Pages: 11 Fees 0.00 Taxes 0.00 Others 0.00 PAID 50.00 City of Bakersfield Planning Commission Resolution No. 05 -13 Approval of Street Re- naming From "Hayes Street" to "Tyree Toliver Street" between East Brundage Lane and Virginia Avenue • I k k I • • • •re: WHEREAS, St. John Missionary Baptist Church, filed an application for a street name change in accordance with Category 2 of City Council Resolution 242 -04; and WHEREAS, the application (File # 13 -0008) requested a change in the street name from "Hayes Street" to "Tyree Toliver Street" between East Brundage Lane and Virginia Avenue, as shown on attached Exhibit "1 "; and WHEREAS, the Planning Commission, through its Secretary, did set, THURSDAY, March 7, 2013, at the hour of 5:30 p.m. in the Council Chambers of City Hall, 1501 Truxtun Avenue, Bakersfield, California, as the time and place for a public hearing before said Planning Commission on said application, and notice of the public hearing was given in the manner provided in City Council Resolution 242 -04; and WHEREAS, the request for the street name change is submitted under Category 2 of Resolution 242 -04, which states: "Category 2: Changes for streets to be named after individuals who have been deceased no less than five years or service organizations or other humanitarian entities which have been out of existence for no less than five years and whose lives or services have been exemplary and brought honor and recognition to the city. "; and WHEREAS, Reverend Toliver was born on April 14, 1923 and passed away on June 12, 2008, which meets the minimum 5 year time period for Category 2; and WHEREAS, in accordance with the application requirement for Category 2 of Resolution 242 -04, the minimum number of property owner signatures must be 50% plus one to proceed with processing the application; and WHEREAS, for this application, a minimum of 43 property owner signatures are required for the application to proceed; and WHEREAS, of the 84 properties along Hayes Street that would be affected by the proposed street name located, a petition was submitted signed by 45 property owners of record as of January 22, 2013; and WHEREAS, the 45 property owners signing the petition constitute 50% plus two property owners, which meets the application requirement to proceed with processing the application; and WHEREAS, the individual, Dr. Tyree Toliver, was pastor of St John Missionary Baptist Church from 1957 through 2007; and WHEREAS, Dr. Toliver served the Bakersfield community through his ministry, as board member to various community and educational programs, such as Bakersfield College Martin Luther King Center, The Holloway Gonzales Library, and California State University Bakersfield; and WHEREAS, Dr. Toliver's life achievements are described in the biographical information attached as Exhibit "2 "; and WHEREAS, the name "Tyree Toliver Street" has been approved with consultation with the public safety agencies responsible for the 911 Emergency Response System and conforms with the California Manual on Uniform Traffic Devices from the California Department of Transportation; and WHEREAS, the laws and regulations relating to CEQA and the City of Bakersfield's CEQA Implementation Procedures, have been duly followed by city staff and the Planning Commission; and WHEREAS, the above described project is Categorically Exempt from the requirements of the California Environmental Quality Act in accordance with CEQA Section 15061 (b) (3), general rule; and WHEREAS, the facts presented in the staff report and evidence at the above referenced public hearings support the findings contained in this resolution; and WHEREAS, at said public hearing held March 7, 2013, the proposed street name change submitted by St. John Missionary Baptist Church, was duly heard and considered and the Planning Commission found as follows: 1. All required public notices have been given. Hearing notices regarding the proposed project were mailed to property owners within 300 feet of the project area and published in a local newspaper of general circulation at least 10 days prior to the hearing. 2. The provisions of CEQA and City of Bakersfield CEQA Implementation Procedures have been followed. Staff determined that the proposed activity is a project and the project is Categorically Exempt from CEQA under Section 15061 (b) (3). 3. The application conforms to the requirements of City Council Resolution 242- 04, Category 2. 4. A petition in support of the application was signed by 45 property owners who own property along Hayes Street, between East Brundage Lane and Virginia Avenue, which exceeds the minimum of 43 property owner signatures as required by Council policy. 5. The effective date of said street name change shall be in approximately 90 days from the date of the final decision regarding this application, as determined by the Planning Director upon consultation with the Public Works Department. 6. The Planning Director shall record this resolution with the Kern County Recorder's Office as described below. NOW, THEREFORE, • . BY THE PLANNING COMMISSION OF OF as •. That the above recitals, incorporated herein, are true and correct. 2. That the map is Categorically Exempt from the requirements of CEQA. 3. That the street name "Hayes Street" shall be replaced by the street name "Tyree Toliver Street" between East Brundage Lane and Virginia Avenue. 4. The effective date shall be inserted below by the Planning Director prior to recordation of this resolution with the Kern County Recorder's Office. This resolution shall be recorded at least 30 days prior to the effective date. The effective date for the street name change from "Hayes Street" to "Tyree Toliver Street" between East Brundage Lane and Virginia Avenue" shall be July 1, 2013. I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Planning Commission of the City of Bakersfield at a regular meeting thereof held on March 7, 2013, on a motion by Commissioner Strong and seconded by Commissioner Dodgin, by the following vote. Page 1 of I Dr. Tyree Toliver(1923 - 2008) _ -- Viewing and visitation for Dr. Tyree Tolliver will be held only Tuesday, June 17, 2008, from 11 a.m. to 6 p.m. with the final viewing to take place Wednesday, June 18, 2008, from 9:30 a.m. to 10:30 a.m. at the family's request. An hour of meditation will be held from 6 p.m. to 7 p.m. at St. John Missionary Baptist Church. The funeral ceremony will be held, with no viewing to take place, Wednesday, June 18, 2008, at 11:00 a.m. at St. John Missionary Baptist Church, 1401 E. Brundage Lane. Interment will follow in union Cemetery. On June 12, 2008 an angel gently whispered to Dr. Tyree Toliver to come and receive his heavenly reward. Dr. Toliver was born April 14, 1923 to Laura Warren and George Toliver in Prescot, Arkansas. He earned a Bachelor of Theology from Conro College, a Masters Degree in Christian Education as well as an Honorary Doctorate from St. John Theological Seminary. During his lifetime he pastured two churches. The first was First Community Baptist Church for three and a half years until he was called to the St. John Baptist Church which he pastured from 1957 until 2007, fifty wonderful years. Under his leadership St. John has grown from seventy members to over twenty -five hundred. The church offers many ministries established by Pastor Toliver, which include but are not limited to, Sunday School, Baptist Training Union, Wednesday night Bible Study, Vacation Bible School, a funeral assistance program, a Substance Abuse and Counseling as well as marriage and family counseling program. In the summer the church has an annual picnic, and goes to the beach. Pastor Toliver loved his community and was very involved. During the Civil Rights Movement, Dr. Toliver marched with Dr. King when he came to Kern County. He continued to march on the birthday of Dr. King as long as his health allowed. He played a crucial role in establishing the Bakersfield College Martin Luther King Center, The Holloway Gonzales Library and was on the advisory board for California State University Bakersfield. He is listed as one of the Movers and Shakers of Kern County. Kern County has lost a Gentle Giant. Dr. Toliver was preceded in death by his son, Paul Toliver. He leaves to cherish his home -going his wife of fifty -nine years, Rosa Toliver; three daughters, Sharon Toliver, Brenda Prince (Albert) of Bakersfield, Patricia Myers (Gregory) of Pomona, CA, two sons, Tyree Toliver (Gloria) and David Toliver (Tameka) of Bakersfield; 12 grandchildren, 5 great - grandchildren, a host of relatives, friends, and his marvelous St. John family. Pastor Tolliver played a very powerful role in advocating non violent protests of injustice, leading marches for equal rights and fair employment. B) The reason for this request is to acknowledge the late Pastor Toliver and recognized all of his accomplishments that are listed above. Stjohn Missionary Baptist Church body hope that the City of Bakersfield Planning Commission will read and view all of the information we the Social Action Committee put with this application and that you all will feel as passionate as we do. Pastor Toliver affected many people lives, and participated in many events for justice and equality for people in southeast Bakersfield.
