September 7, 2016 City Council Meeting
REGULAR MEETING - 3:30 p.m.
NOTE: A separate meeting will be called to order at 3:30 p.m., followed by Public Statements
that will encourage comments pertaining to Closed Session matter only. The Council will then
recess into Closed Session. Upon conclusion of the Closed Session, any Closed Session
action will be announced prior to adjournment of the meeting. At 5:15 p.m., the Regular
Meeting will be called to order to address the remainder of the agenda items.
CLOSED SESSION
There will be a conference with legal counsel regarding three items of existing litigation.

WORKSHOPS
Item 6a. 9/11 Memorial Update. Staff from the Bakersfield Fire Department will provide an
update on the construction of the 9/11 Memorial located between the Bakersfield Police
Department Westside Substation and Fire Station No. 15.
CONSENT CALENDAR
Ordinances
Item 8c. Food Trucks. During the August 17th City Council meeting, staff presented a
proposed ordinance outlining new regulations for the operation of food trucks within the City.
After Council discussion, staff was directed to bring the first reading of the ordinance to the
Council for consideration at the next meeting. As a result of the discussion during the August
17th meeting, the proposed ordinance includes a 75 foot operating buffer from brick and
mortar restaurants and specific times of operation for food trucks, based on the day of the
week and the zoning of the area in which the food truck is operating. Staff is requesting the
Council approve the first reading of the ordinance. If approved, the item will be placed on
the September 28th City Council agenda for second reading and approval.
Resolutions
Item 8i. Mesa Marin Sports Complex - Phase II. As part of the ongoing development of the
Mesa Marin Sports Complex, Phase II includes, in part, the installation of new playground
equipment and safety surfacing. In an ongoing effort to leverage outside funding for various
City projects, the Recreation and Parks Department has been awarded a grant by Playcore
Playground Equipment. The grant matches up to 40 percent of the purchase of this specific
type of playground equipment. This allows staff to enhance the equipment to be installed at
the complex. Staff is requesting Council's approval of a resolution to dispense with bidding
for this item as a result of staff receiving the grant for this specific type of equipment.
Agreements
Item 8m. Community Action Partnership of Kern. In a collaborative effort with the County of
Kern, the City Council approved a $132,000 Community Development Block Grant
contribution in FY 2015 -16 to the Community Action Partnership of Kern to make solar
improvements at its food bank facility. The project is projected to generate energy savings,
which is expected to result in corresponding operating savings for the Food Bank. This savings
will allow the organization to redirect the funds to further enhance the services it provides to
residents of the City and unincorporated county areas. Staff is requesting the Council
approve a three party agreement with CAPK and the County to allow the project to move
forward.
NEW BUSINESS
Item 13a. League of California Cities Annual Conference - Voting Delegate(s) and City
Position on Conference Resolutions. Each year the League of California Cities hosts an
annual conference during which proposed League resolutions will be considered. League
resolutions generally consider taking action on issues impacting municipalities across the
state. Currently, there is one proposed resolution that will be considered during the annual
conference. Staff is recommending the City take a neutral position on the resolution. In
addition, the League requires the Council to appoint one of its members as the City's voting
delegate and up to two alternate voting delegates. Staff is requesting the Council appoint a
voting delegate and alternate delegate(s) and adopt staff recommended position on the
League proposed resolution.
