The meeting was called to order by Vice-Mayor Bleecker. The City Clerk called the roll as follows: Present: Councilmen Rogers, Sceales, Strong, Barton~ Bleecker, Christensen, Medders Absent: Mayor Hart Councilman Rogers, member of the Governmental Efficiency and Personnel Committee, read Report No. 12-76 regarding Salaries and Supplemental Benefits, as follows: In compliance with state law and the Employer- Employee Relations Ordinance, the City's designated representative, Nick Counter, along with the management team, has held numerous meet and confer sessions with representatives of the Kern County Employees Association which represents the City's Blue and White Collar Unit employees. In addition, Mr. Counter and the management team have consulted with repre- sentatives of the General Employees Supervisory Unit, the Confidential Unit, Police Unit and Police Supervisory Unit. The Governmental Efficiency and Personnel Committee has met with the Management Unit regarding salaries and supplemental benefits. Once again the City's meet and confer sessions were conducted so as to reflect the total compensation concept rather than a straight salary percentage to establish increases. For the Council's information, this concept takes into consideration all City costs for employees by units. Such costs as retirement, workers' compensation, overtime, uniform allowance, stand-by pay, and educational incentive pay are taken into consideration. For example, in the Blue and White Collar Units, the proposed total compensation increase for 1976-77 is 7.2%; however, of this 7.2%, 5.75% is strictly for salaries. The remaining 1.45% would be for supplemental benefits. As the Council is undoubtedly aware, increases in the past were based on salary alone; how- ever, last year, taking into account the fact that fringe benefits have increased tremendously over the years, we could no longer consider them as just fringes. Based upon guidelines established by the City Council and facts presented to the City's designated representative Bakersfield, California, July 12, 1976 - Page 2 and management team during the meet and confer sessions, the Governmental Efficiency and Personnel Committee makes the following recom- mendations for salaries and supplemental benefits as follows: Blue and White Collar Units (Represented by the Kern County Employees Assoc.; a two-year agreement) 1. Effective the first pay period in July, 1976, a 5% across-the-board salary increase. 2. Effective the first pay period in April, 1977, a 3% across-the-board salary increase. 3. Effective the first pay period in July, 1977, a 4% across-the-board salary increase. 4. Effective the first pay period in April, 1978, a 4% across-the-board salary ~ncrease. 5. The $40 per month given last year towards the employee's contribution to the Public Employees Retirement System shall be applied in the salary schedule at the first step. 6. Increase the City's contribution to medical insurance programs by $16.50 per month. 7. Increase the City's contribution to medical insurance programs by an amount not to exceed 10% of the City's contribution if such an increase in the plan is required during fiscal year 1977-78. This agreement costs $290,000 during fiscal year 1976-77 and averages 7.2% o£ total compen- sation. The second year costs $215,000 and averages 5.2% of total compensation. Mr. Bud Kaye, Manager of the Kern County Employees Association, Local 700 (S.E.I.U.), assured the Council that the salary figures that were printed in the Friday, July 9, 1976, issue of the Bakersfield Cali£ornian were not released by any member of his sta£f or Local 700's negotiating team and also stated that the agreement, as signed, is a fair and equitable package and urged Council ratification. Police Unit 1. Effective the first pay period in July, 1976, a 4% across-the-board salary increase. 2. Effective the first pay period in April, 1977, a 4% across-the-board salary increase. Bakersfield, California, July 12, 1976 - Page 3 Increase the City's contribution to medical insurance programs by $16.50 per month. Increase the City's contribution by 25% to cover 100% of the premium for a life insurance policy in the amount of $10,000. Increase the City's contribution by $50 to a total of $150 annually towards a uniform allowance. Non-safety employees required to wear uni- forms reimbursed $50 per year towards a uniform allowance. o Officers assigned to two-wheel motorcycle duty compensated an additional $15 per month to a total of $50 monthly for the performance of such duties. Recommend a complete study be conducted during 1976-77 regarding improvements in the Public Employees Retirement System. This package totals $185,500 or 6.2% of total compensation for fiscal year 1976-77. Police Supervisory Unit 1. Effective the first pay period in July, 1976, a 4% across-the-board salary increase. 2. Effective the first pay period in January, 1977, a 2% across-the-board salary increase. 3. Increase the City's contribution to medical insurance programs by $16.50 per month. Increase the City's contribution by $50 to a total of $150 annually towards a uniform allowance. The total cost of this package is $30,200, or 5.9% based on total compensation for fiscal year 1976-77. Confidential Unit Effective the first pay period in July, 1976, a 5% across-the-board salary increase. ° Effective the first pay period in April, 1977, a 3% across-the-board salary increase. Increase the City's contribution to medical insurance programs by $16.50 per month. The $45 per month given last year towards additional salary compensation shall be applied in the salary schedule at the first step. The total cost of this package is $24,000, or 8.1% based on total compensation for fiscal year 1976-77. Bakersfield, California, July 12, 1976 - Page 4 169 General Employees Supervisory Unit Effective the first pay period in July, 1976, a 4% across-the-board salary increase. 2. Effective the first pay period in January, 1977, a 2% across-the-board salary increase Increase the City's contribution to medical insurance programs by $16.50 per month. The total cost of this package is $50,200, or 6.1% based on total compensation for fiscal year 1976-77. Management Unit 1. Effective the first pay period in July, 1976, a 4% across-the-board salary increase 2. Effective the first pay period in January, 1977, a 2% across-the-board salary increase Increase the City's contribution to medical insurance programs by $16.50 per month. The total cost of this package is $99,300, or 5.6% based on total compensation. Retired Employees A cost of living adjustment of 15% to miscellaneous retired employees who retired prior to July 1, 1971. The total cost is $6,975. A salary adjustment for the Assistant City Clerk who has assumed the majority of responsibilities in the City Clerk's Office. This employee is to be transferred from the Confidential Unit to the Supervisory Unit at a salary of $1025 to $1249 per month. The total cost is $2,764. The total cost of these packages is $691,703, or 6.5% increase of total compensation for all units. In order to implement these changes, the Govern- mental Efficiency and Personnel Committee recommends Council approval of the attached memorandums of understanding with the Kern County Employees Association, Local 700; approve the attached amendments to the personnel and compensation ordinance and the attached resolutions setting salaries and supplemental benefits; and adoption of the attached salary schedule. Councilmen Rogers added an addendum to the report as follows: Increase part-time employees salaries by 20~ per hour at a total cost of $17,000.00 for this package. 170 Bakersfield, California, July 12, 1976 - Page 5 Ayes Noes Absent: Councilman Rogers made a motion that Report No. 12-76 of the Governmental Efficiency and Personnel Committee regarding Salaries and Supplemental Benefits, be accepted, and Memorandum of Understanding befween the City of Bakersfield and the Kern County Employees Association, Inc., Local 700 Service Employees' International Union, AFL-CIO, be approved. Councilman Medders stated that he is not against the salary increases for this fiscal year, but is totally against the two year agreements unless it can be made clear where the City is going to get the funds to finance the second year. Councilman Sceales stated he supports mental Efficiency and Personnel Committee report year program. Upon a motion by Councilman Rogers, Resolution No. 46-76 of the Council of the City of Bakers£ield setting Salaries and Related Benefits for Officers and Employees of the City o£ Bakers- was adopted by the following roll call vote: field, Ayes: Councilmen Rogers, Strong, Barton, Bleecker, Christensen Noes: Councilmen Sceales, Medders Absent: None Councilman Rogers, member of the Governmental Efficiency and Personnel Committee, read Report No. 13-76 regarding Additional Personnel, Reclassifications for Fiscal Year 1976-77, as follows: During the past few months the City Manager's Office has reviewed various budget requests for additional personnel from department heads. Departmental requests were made for 36 addi- tional employees which, if allowed, would result in an additional cost of approximately one-half million dollars. After reviewing (1) the total budget requests for fiscal year 1976-77; (2) the present ser- vice level; and (3) anticipated revenue, the City Manager reduced these requests from 36 to 16 new positions. On May 26, 1976, the City Council rescinded the utility tax ordinance which significantly reduced antici- pated income; therefore, the City Manager further reduced his recommendations regarding these new positions. The City Manager's recommendations for new positions and reclassi- fications with no reduction in services are as follows: New Positions and Classifications One (1) additional position of Clerk Typist I Fire Dept.: Total Cost: $9,960 One (1) additional position of Building Inspector II - Building Department: Total Cost: $15,475 Bakersfield, California, July 12, 1976 - Page 7 One (1) additional position of Clerk Typist II - Planning Department: Total Cost $10,100 One (1) Clerk I $9,225 additional position of Accounting Finance Department: Total Cost: One (1) additional position of Engineering Draftsman - Public Works: Total Cost: $12,640 Six (6) new classifications of Community Service Technician - Police Department: Total Cost: $67,560 A new classification of Student Help in the temporary and seasonal salary schedule. Total Cost: -0-* *This position should result in a savings to the City in that student help at a lesser rate of pay will be used. Reclassifications Transfer one (1) Tree Maintainer II from Right-of-Way Section to Parks and reclassify to Maintenance Crafts Worker I; transfer one (1) Tree Maintainer I from Right-of-Way to Parks and reclassify to Trades Assistant; transfer one (1) Tree Maintainer I from Right-of-Way to Parks and reclassify to Park Maintainer: Total Cost: $3,300 2. Reclassify one (1) Personnel Clerk to Personnel Technician: Total Cost: $1,627 Hold the Deputy Fire Chief pay rate at its present level until such time as the Assistant Fire Chief pay rate is at the same level: Total Cost: -0- TOTAL COST: $129,887 Attached to this report are indepth justifi- cations by the City Manager regarding these additional personnel and reclassifications. The Governmental Efficiency and Personnel Committee has reviewed these final requests for additional personnel and reclassifications, and recommends Council approval of this report and the attached job specifications. M., July 12, 1976. The meeting was called to order by Vice-Mayor Bleecker followed by the Pledge of Allegiance and Invocation by Reverend Clyde Skidmore of the First Southern Baptist Church. Recess Meeting. Regular Council Meeting was recessed at 8:05 P.M. to continue Budget Sessions regarding employees, with various reports from the Governmental Efficiency and Personne~ Committee. Regular Council Meeting was reconvened at 9:10 P.M. Correspondence. Upon a motion by Councilman Medders, communication from Warner Cable of Kern County, dated June 25, 1976, requesting a rate increase, was received and referred to the staff for evaluation and hold in abeyance until the Kern County Board of Supervisors takes action on this request. Mr. Howard Channell, General Manager of Bakersfield Cable TV, reported that their newly installed microwave system is now operating in the City and working very well and the special service channel should be available to subscribers in the near future. Upon a motion by Councilman Sceales, communication and Executive were petition from Postal employees requesting that street installed on 13th Street, directly east of "S" Street, and referred to the Public Works Department for study mendation back to the Council. lights be was received and recom- Bakersfield, California, July 12, 1976 - Page 2 175 Upon a motion by Councilman Medders, communication £rom Gannon Realty, dated July 6, 1976, requesting that the Planning Commission draw some conclusion as to their intent for the ulti- mate zoning of land located on the south side of White Lane between Wible Road and Stine Road, was received and re£erred to the Planning Commission. Reports. Councilman Rogers, member of the Governmental Efficiency and Personnel Committee, read Report No. 14-76 regarding Fees for Modified and Central Alarm Stations, Alarm Agents and Alarm Users, as follows: At the City Council meeting of June 28, 1976, the Council referred a Resolution dealing with the establishment of fees as prescribed by the Alarm Ordinance to this Committee for report and recommendation. On Tuesday, July 6, 1976, the Committee met with representatives of the alarm industry and discussed the establishment of the proposed fees in great detail. As a result of its discussions, a few changes have been made in the Resolution that was presented on June 28th. The renewal of Central Alarm Station per- mits was raised to $25 to reflect the additional inspection costs necessary to review those accounts that were not part of the Underwriters Laboratories certifi- cation. The permit fees for the Alarm User Permits were reduced to an amount equal to the City's cost o£ printing the necessary forms. In future years, the alarm companies may choose to have their own approved forms printed, in which case there would be no permit fee levied by the City. It is the recommendation of this Committee that the attached Resolution fixing fees for Central Stations, Modified Central Stations, Alarm Agents and Alarm Users be approved. Upon a motion by Councilman Rogers, Report No. 14-76 of the Governmental Efficiency and Personnel Committee regarding Fees for Modified and Central Alarm Stations, Alarm Agents and Alarm Users, was accepted. Adoption of Ordinance No. 2284 New Series o£ the Council of the City of Bakersfield adding Chapter 7.12 to Title 7 of the Municipal Code enacted under Section 19 of Article IV of the State Constitution allowing Bingo Games in the City for benefit of Charitable Organizations. Mr. Pete Caciuc, representing the American Legion, stated that several fraternal organizations met to discuss the new Bingo Ordinance and as a whole they are satisfied with the Ordinance as written. Christensen, Medders, New Business. Approval of Agreement between Robert T. Perry and the City of Bakersfield for Construction Inspector's Services. Upon a motion by Councilman Medders, Agreement between Perry and the City of Bakersfield for Construction Approval of Construction Change Order No. 1 to Contract No. 76-79 with Fred S. Macomber for work on new Corporation Yard Facilities. The Public Works staff has been working with the Archi- tect and Contractor on revisions to the contract work that would result in savings to the City. This Change Order provides for the following: Delete Security Lighting. It will be more economical to provide standard street lighting than the sodium luminaries proposed. The standard lighting will be added later. 2. Revise hydrant system piping to decrease quantity of pipe. 3. Reduce number of car fume exhaust removal connections. 4. Raise finish grade to provide balanced earthwork. same. Yard Facility, was approved and the Mayor was authorized to execute Inspector's Services to supervise construction of new Corporation Bakersfield, California, July 12, 1976 - Page 6 179 This Change Order results in a decrease o£ $69,105.00 in the contract price. No additional time is required as a result of this Change Order. Upon a motion by Councilman Medders, Construction Change Order No. 1 to Contract No. 76-79 with Fred S. Macomber for work on new Corporation Yard Facilities, was approved and the Mayor was authorized to execute same. Authorization granted to increase Imprest Cash Fund at Corporation Yard. Upon a motion by Councilman Sceales, authorization was granted to the Finance Director to increase the Imprest Cash Fund at the Corporation Yard from $300.00 to $500.00. Hearings. This is the time set for continued hearing before the Council for hearing report of Building Director specifying work done, cost of work and description of property upon which Dangerous Buildings have been demolished and hearing protests or objections thereto. The public portion o£ the hearing was closed at the Council Meeting of June 28, 1976. This hearing was held over from the Council Meeting of June 28, 1976 in order to clear up the matter of Fred L. Haynes' property located at 106 Northrup Street. After discussion, upon a motion by Councilman Strong, Resolution No. 49-76 of the Council of the City of Bakersfield con£irming the Report of the Building Director re Assessments of certain properties in the City for demolition of Dangerous Buildings, with the deletion of Parcel No. 18-270-26, located at 106 Northrup Street, within Ayes Noes: Absent: Mayflower Addition, Lot 28, thirty days, was adopted by Councilmen Strong, Bleecker, Sceales None Councilman Barton Block 14, which will be considered the following roll call vote: Christensen, Medders, Rogers, 180 Bakersfield, California, July 12, 1976 - Page 7 This is the time set for public hearing on application by F. A. Curry to amend the zoning boundaries from an R-4 (Multiple Family Dwelling) Zone to a C-1 (Limited Commercial), or more restrictive, Zone, affecting that certain property in the City of Bakersfield commonly known as 1201 Beale Avenue. This hearing has been duly advertised, the property posted and the property owners have been notified as required by law. A negative declaration is on file. The Planning Com- mission found the requested C-1 zoning consistent with the Land Use Element of the General Plan and recommended approval subject to the application of the "D" Design Overlay to assure a compatible development with the adjacent residential area. No protests were received by the Planning Commission on the requested zone change. Vice-Mayor Bleecker declared the hearing open for public participation. Mr. F. A. Curry, the applicant, was present to answer questions of the Council. No protests or objections being received, the public portion of the hearing was closed for Council deliberation and action. Upon a motion by Councilman Christensen, Ordinance No. 2285 New Series amending Title Seventeen of the Municipal Code of the City of Bakersfield by changing the Land Use Zoning of that certain property in the City of Bakersfield commonly known as 1201 Beale Avenue, finding that said zoning to C-1-D (Limited Commercial - Architectural Design) Zone would not have a substantial adverse impact on the environment and that it is consistent with the General Plan, was adopted by the following roll call vote: Ayes Councilmen Strong, Barton, Bleecker, Christensen, Medders, Rogers, Sceales Noes None Absent: None Bakersfield, California, July 12, 1976 - Page 8 181 Adjournment.
