AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTIONS 5.06.060 A. AND
B. OF THE BAKERSFIELD MUNICIPAL CODE RELATING
TO ADULT BOOKSTORES.
W~EREAS, the City has a substantial interest in
preventing the kind of unlawful conduct, as well as the health and
safety problems, which may be anticipated in adult bookstores and
picture arcades where booths are concealed or enclosed; and
WHEREAS, prohibition of such booths furthers the City's
interest in deterring and detecting the use of the premises for
such unlawful activity.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
SECTION 1.
Sections 5.06.060 A. and B. of the Bakersfield Municipal
Code are hereby amended to read as follows:
5.06.060 Operating conditions.
A. No licensee shall conduct, operate, or allow to be
conducted or operated any adult bookstore unless the permittee, or
in his absence another adult acting as permittee's agent, is
present on the premises whenever such bookstore is open for
business.
B. No licensee or other person shall conduct, operate,
or allow to be conducted or operated any adult bookstore or
picture arcade having any partially or fully enclosed booth or
partially or fully concealed booth. No exterior door to any adult
bookstore or picture arcade shall be locked or barred during hours
when such business is open to the public.

SECTION 2.
This ordinance shall be posted in accordance with the
City charter provisions and shall become effective thirty (30)
days from and after the date of its passage.

I HEREBY CERTIFY that the foregoing ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 23st day of May , 198--6, by the
following vote:
