HomeMy WebLinkAboutORD NO 3043ORDINANCE NO. 3043 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING TITLE SEVENTEEN OF THE BAKERSFIELD MUNICIPAL CODE BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED NEAR EAST HILLS DRIVE AND SILL PLACE, TRACT 3836. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the city of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of those certain properties in the City of Bakersfield located near East Hills Drive and Sill Place, Tract 3836; and WHEREAS, the Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject properties from an R-2 (Limited Multiple-Family Dwelling) Zone to an R-1 (One Family Dwelling) or more restrictive Zone, and the Council has consid- ered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed pro- ject; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearing for a change of zoning of said properties, that a zoning change should be authorized; and WHEREAS, the city Council has determined and found that the proposed zoning is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project, and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon, and this Council hereby approves and adopts the Negative Declaration. 3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of certain properties in said City, the boundaries of which properties are shown on the map hereto attached and made a part hereof, as follows: FROM AN R-2 (LIMITED MULTIPLE-FAMILY DWELLING) ZONE TO AN R-1 (ONE FAMILY DWELLING), OR MORE RESTRICTIVE ZONE: (3) Parcels of land situated in Section 23 in Township 29 south, Range 28 east, M.D.B.&M. in the City of Bakersfield, County of Kern, State of California more particularly described as follows: PARCEL 1: Lot 16 of Tract No. 3836 recorded in Book 26 of Maps at Page 187 on February 17, 1977, in the office of the Kern County Recorder. Excepting therefrom any portion lying within the south 165.00 feet of said lot 16. PARCEL 2: Lot 13 and lot 14 of said Tract No. 3836. Excepting therefrom any portion of lot 13 lying within the south 265.00 feet of said Tract No. 3836, (said south 265 feet also being the south 26.83 feet of lot 13). PARCEL 3: Beginning at the of lot 11 of said Tract No. Thence north 00-04'20" east, the True Point of Beginning: southeast corner 3836; 265.00 feet to Thence south 89°50'06" west, 29.57 feet to a point on the east line of said Tract No. 3836; Thence north 00°30'31" east, along said east line, 37.50 feet; Thence north 11°25'23" east along said east line, 98.77 feet; Thence north 11°01'57" east along said east line 51.75 feet; Thence, departing said east line, south 00°04'20" west, 185.02 feet to the True Point of Beginning. 2 This ordinance shall be posted in accordance with the City charter provisions and shall become effective thirty (30) days from and after the date of its passage. .......... o0o ..........
