AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTIONS 8.32.030 A.,
B., C., Do, E.2. AND F., 8.32.040, 8.32.050,
8.32.130, 8.32.140 A., E. AND F., 8.32.150 A.2.,
8.32.160 D., 8.32.170 A., B., AND D., 8.32.180,
AND REPEALING SECTION 8.32.060 B. OF THE
BAKERSFIELD MUNICIPAL CODE REGARDING REFUSE
COLLECTION CHARGES.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
Section 8.32.030 A., B., C., D., E.2., and F. of the
Bakersfield Municipal Code is hereby amended to read as follows:
8.32.030 Nature and schedule of disposal charges.
A. Single-family dwellings shall have the following:
1. Fifty-four dollars ($54.00) annual charge;
2. Permitted refuse containers, one or more
standard containers;
3. Service, twice per week pickups.
B. Multiple-family dwellings shall have the following:
1. For duplexes, triplexes and fourplexes,
forty-eight dollars ($48.00) per dwelling unit annual charge;
2. For complexes of more than four dwelling units,
four dollars ($4.00) per dwelling unit monthly charge, with the
use of standard containers and twice per week pickups.
C. For all other uses, properties utilizing detachable
bins, more than two standard containers, and/or more than twice
per week pickups, the monthly charges set forth in Schedules A
and B, Sections 8.32.040 and 8.32.050, as applicable.
D. Any place, premises or use of property using the
stationary compactor and dropoff box: seventy dollars ($70.00)
shall be charged per collection.
E. 2. Charges for such special collection shall be
forty dollars ($40.00) per hour with a minimum charge of seven
dollars ($7.00) for the first ten minutes or fraction thereof.
Time charged after the first ten minutes shall be on the basis of
five-minute intervals calculated to the nearest five minutes.
Such charges may be adjusted from time to time by the Community
Services Manager, with the approval of the City Manager, to
reflect the actual total cost of providing such service.
Whenever any residential property has refuse containers which are
not placed in accordance with Section 8.32.140, there shall be an
additional charge of three dollars ($3.00) per month per location.
F. Industries in the city shall be responsible for the
proper collection and removal of industrial waste from their
premises. The Community Services Manager shall determine what is
and what is not industrial waste. Charges set forth in this
section shall not apply to industrial waste.
SECTION 2.
Section 8.32.040 of the Bakersfield Municipal Code is
hereby amended to read as follows:

F. Compactor bins shall be charged three times the
established normal detachable bin rates as set forth in the
tables above.
SECTION 3.
Section 8.32.050 of the Bakersfield Municipal Code is
hereby amended to read as follows:

SECTION 4.
Section 8.32.060 B. of the Bakersfield Municipal Code is
hereby repealed.
SECTION 5.
Section 8.32.130 of the Bakersfield Municipal Code is
hereby amended to read as follows:
8.32.130 Required containers.
Every occupancy and person shall at all places or
premises in the city maintain sufficient clean containers, free
from jagged edges and in good repair and strength to hold all

refuse created, produced, or accumulated on the place or premises
between regular twice a week collections, unless a more frequent
schedule has been approved by the Community Services Manager.
A. A sufficient number of containers shall mean, but
not be limited to the following minimum:
1. Single-family dwellings, one standard container;
2. Multiple-family dwellings, detachable bin-boxes
of capacity required by the Community Services Manager, but where
not used, a minimum of one standard container per unit;
3. Other places, premises and uses of property,
detachable bin-boxes of capacity required by the Community
Services Manager but where not used, a minimum of one standard
container per unit;
4. If any place, premises or use of property
accumulates or generates twelve or more cubic yards of refuse per
day, the Community Services Manager may require the occupant to
provide and install a stationary compactor and dropoff box of
sufficient capacity to hold accumulated refuse, as determined by
the Community Services Manager.
B. When not being filled or emptied, all containers
must be kept tightly closed, and it is unlawful for any person,
not authorized to do so, to open such containers to collect or to
scatter the refuse stored therein.
SECTION 6.
Section 8.32.140 2., E. and F. of the Bakersfield
Municipal Code is hereby amended to read as follows:
8.32.140 Collection points.
A. in those portions of the city where there is an
alley abutting the premises, all properly prepared refuse shall
be placed adjacent to the alley as near as possible to the
property line; except when impracticable, such containers shall
be placed as directed by the Community Services Manager.

E. Detachable bin refuse containers shall be placed on
four-inch thick, six-foot by eight-foot concrete slabs at grade
level or on slabs of similar construction or material if approved
by the Community Services Manager.
F. The Community Services Manager may require an
enclosed structure around detachable bin refuse containers if he
determines an unenclosed bin to be unsightly.
SECTION 7.
Section 8.32.150 A.2. of the Bakersfield Municipal Code
is hereby amended to read as follows:
8.32.150 Preparation of refuse.
A. 2. Swill, when the Community Services Manager
determines a premises is producing it in sufficient quantities so
as to be salvageable, shall be separately accumulated in standard
containers, otherwise it shall be prepared as garbage.
SECTION 8.
Section 8.32.160 D. of the Bakersfield Municipal Code is
hereby amended to read as follows:
8.32.160 Collection and disposal.
D. Any person in the city authorized as a collector
shall collect at least twice per week or more frequently as
required by the Community Services Manager all refuse accumulated
at any premises in the city accumulating and generating such
refuse.
SECTION 9.
Section 8.32.170 A., B. and D. of the Bakersfield
Municipal Code is hereby amended to read as follows:
8.32.170 Enforcement--Powers and duties of Community
Services Manager.
A. The Community Services Manager shall supervise
collection and removal of all refuse by the city and shall
enforce the provisions of this chapter.

B. The Community Services Manager shall establish
routes and days for collection and may change same from time to
time. When such routes and days are established or changed, he
shall give such notice thereof as he may deem advisable.
D. The Community Services Manager, with the approval of
the City Manager, shall make such rules and regulations not
inconsistent with the provisions of this chapter as may be
necessary, reasonable and proper to effect the expeditious,
economical and efficient collection and removal of refuse by the
city. Such rules and regulations may also relate to the required
frequency of refuse collections at various locations, the type
and number of refuse containers required, and the vehicles used
in making such collections. The determination of the Community

SECTION 10.
Section 8.32.180 of the Bakersfield Municipal Code is
hereby amended to read as follows:
8.32.180 Violation--Penalty.
Any person violating any of the provisions of this
chapter or wilfully and knowingly refusing to comply with the
rules, regulations and determinations of the Community Services
Manager shall be guilty of a misdemeanor and, upon conviction
thereof, shall be punishable by a fine not to exceed five hundred
dollars or by imprisonment in the county jail for a period not to
exceed six months, or by both fine and imprisonment.
SECTION 11.
This ordinance shall be posted in accordance with the
city charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
