A RESOLUTION DETERMINING THAT
INSPECTION, MAINTENANCE AND REPAIR
SERVICES FOR THE LIQUIFIED NATURAL GAS
(LCNG) FUELING FACILITIES CANNOT BE
REASONABLY OBTAINEDTHROUGH THE USUAL
BIDDING PROCEDURES AND AUTHORIZING THE
FINANCE DIRECTOR TO DISPENSE WITH
BIDDING THEREFORE AND PURCHASE
INSPECTION, MAINTENANCE AND REPAIR
SERVICES FOR THE LCNG FUELING FACILITIES
THROUGH CLEAN ENERGY, NOT TO EXCEED
$200,000 OVER A THREE -YEAR TERM.
WHEREAS, CITY is in need of inspection, maintenance and repair services for
the liquidized natural gas (LCNG) fueling facilities located at the Corporation Yard
and South Mt. Vernon Avenue; and
WHEREAS, CITY is also in need of additional work to prevent an emergency
shut down of the Corporation Yard LCNG fueling facility; and
WHEREAS, the Corporation Yard fueling station currently fuels 63 LNG vehicles,
which are comprised of 58 refuse vehicles, one service truck, and four dump trucks,
in addition to 18 CNG street sweepers, and one CNG traffic line marker, as well as
the contracted private refuse hauler's nine LNG vehicles; and
WHEREAS, Staff only knows of one other local vendor capable of performing
the repairs; however, in the past, this vendor was not willing to sign the City's
contract without significant changes to the boilerplate; and
WHEREAS, Clean Energy is the only local service provider that staff knows of
capable of performing the necessary services for the LCNG fueling facilities;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
The above recitals are true and correct and incorporated herein by
reference.
2. As the only inspector and service provider that staff knows of willing to
complete the City's contract, the services can only be reasonably obtained from
one vendor, Clean Energy, because of the need to successfully inspect, repair and
maintain such equipment that are already in operation within the City system.

3. The Finance Director is authorized to dispense with bidding in
accordance with Section 3.20.060 of the Bakersfield Municipal Code.
4. The expenditure of funds for said parts shall not exceed Two Hundred
Thousand Dollars ($200,000) over a three -year term.
I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular meeting thereof held
