NEW SERIES
AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTION 5.58.030 E. OF,
AND ADDING SECTION 5.58.045 TO, THE BAKERSFIELD
MUNICIPAL CODE RELATING TO SEISMIC SURVEY
ACTIVITIES.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
Section 5.58.030 E. of the Bakersfield Municipal Code is
hereby amended to read as follows:
5.58.030 Application.
E. A statement signed by the applicant that he has
reviewed, is familiar with, and agrees to comply with the
requirements of this chapter and to repair to satisfaction of the
Manager any damages resulting from applicant's seismic survey
activities.
SECTION 2.
Section 5.58.045 is hereby added to the Bakersfield
Municipal Code to read as follows:
5.58.045 Inspections--Minimum setbacks---Damages.
A. Each appilcation fee shall include an amount suffi-
cient to offset the city's costs in inspecting all infrastructure
along the proposed route before and after seismic survey activity
is conducted.
B. No seismic survey activities may be conducted within
300 feet of any water well or within 100 feet of any surface
structure, of any irrigation facilities, or of pipes determined
by the Manager to be of poor structural quality. To the extent
the latter are disclosed by the inspection of infrastructure pre-
ceding the seismic survey activity, information thereon shall be
provided applicant at his request.
C. Applicant's responsibility £or repair of any result-
ing damages shall not be limited to infrastructure identified in
the pre-activity inspection.
SECTION 3.
This ordinance shall be posted in accordance with the
City charter provisions and shall become effective thirty (30)
days from and after the date of its passage.

I HEREBY CERTIFY that the foregoing Ordinance was passed
and adopted by the Council of the City of Bakersfield at a regu-
lar meeting thereof held on the 30th day of July , 1986, by
the following vote:
