A 9 1 8 AN ORDINANCE ADDING SECTIONS 17.04.129 AND 17.04.154 AND AMENDING SECTION 17.08.050 OF THE BAKERSFIELD MUNICIPAL CODE RELATING TO COMMERCIAL CANNABIS ACTIVITY. BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Sections 17.04.129 and 17.04.154 of the Bakersfield Municipal Code are hereby enacted to read as follows: Chapter 17.04 Definitions 17.04.129 Cannabis. "Cannabis" means all parts of the plant Cannabis sativa Linnaeus, Cannabis indica, or Cannabis ruderalis, whether growing or not; the seeds thereof; the resin, whether crude or purified, extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds, or resin. "Cannabis" also means the separated resin, whether crude or purified, obtained from cannabis. "Cannabis" does not include the mature stalks of the plant, fiber produced from the stalks, oil or cake made from the seeds of the plant, any other compound, manufacture, salt, derivative, mixture, or preparation of the mature stalks (except the resin extracted therefrom, fiber, oil, or cake, or the sterilized seed of the plant which is incapable of germination. The terms "marijuana" and .,cannabis" are interchangeable throughout this Code. 17.04.154 Commercial Cannabis Activity. "Commercial Cannabis Activity" is the cultivation, manufacture, distribution, processing, storing, laboratory testing, packaging, labeling, transportation, delivery or sale of cannabis and cannabis products as provided for in the Medicinal and Adult -Use Cannabis Regulation and Safety Act as set forth in state law. o�0AKF9T s Page I of 3 Pages - m U O ORIGINAL SECTION 2. Section 17.08.050 of the Bakersfield Municipal Code is hereby amended to read as follows: 17.08.050 Prohibited uses. The following uses are specifically prohibited within any zone district: A. Medical marijuana dispensary. B. Commercial cannabis activity. SECTION 3.
